AN ORDINANCE AMENDING ORDINANCE 2007-OR-87, AN ORDINANCE
AMENDING ORDINANCE 2007-OR-63 THAT ESTABLISHED THE
JEFFERSONVILLE COMMON COUNCIL SPECIAL NON-REVERTING FUND
FOR ANNEXATION COSTS INCURRED DURING 2008 AND 2009
WHF,RF.AS, IC 36-1-2-6(3) designates the Common Council of the City of
Jeffersonville as the Fiscal Body of said city, and
WHEREAS, IC 36-1-2-9(3) designates the Common Council of the CiTy of
Jeffersonville as the Legislative Body of said city, and
W HF.I2EAS, IC 36-1-3-3 states that if there is any doubt as to the existence of a power of
a unit, the resolution shall be that this power exists, and
WIiF.REAS, IC 36-1-3-4 states that a unit has all other powers necessary or desirable in
the conduct of its affairs, even though not granted by statute, and
WHEREAS, IC 36-4-6-18 grants the legislative body of a city, through the passage of
ordinances, orders, resolutions, and motions the authority to control [he city's property
and finances, and
WHEREAS, The Common Council of the City of Jeffersonville is aware of, and wishes
to be prepared for costs that will be incurred daring 2008 for the ramping up of Ciry
services in preparation of certain mandated City services that must begin effective
January 1, 2009, and
WHF,RF.AS, "fhe Common Council of the Ciry of Jeffersonville intends to transfer into a
special non-reverting fund monies that will be used to fund the aforementioned
annexation costs for 2008 and/or 2009,
NOW, THEREFORE, LET IT BE ORDAINED BY THE COMMON COUNCIL
OF THE C1TY OF JEFFERSONVILLE:
SECTION 1: "fhe Jeffersonville Common Council Special Non-Reverting Fund for
annexation costs incurred during 2008 and/or 2009 is hereby created.
SECTION 2: Funds will be transferred into said Common Council Special Non-
Reverting Fund from the COPS Grant Fund, The Non-Reverting Health Insurance Fund,
and any other sources of revenue the Common Council may deem appropriate.
SECTION 3: The Jeffersonville Common Council Special Non-Reverting Fund for
annexation costs incurred during 2008 and/or 2009 is hereby funded with $1,000,000.00
as follows:
A. $598,408.00 from the COPS Grant,
B. $201,592.00 from the Cumulative Capital Improvement Fund, and
C. $200,000.00 from the EDIT Fund.
SECTION 4: Common Council Special Non-Reverting Fund expenditures and/or
purchases may not be made without a Purchase Order and/or Resolution approved and
signed by the Council
SECTION 5: Any existing ordinance, or section(s) of existing ordinances that are in
conflict with this ordinance aze hereby repealed.
This ordinance shall be deemed adopted and in effect after passage by the Common
Council of the City Of Jeffersonville and approval by the Mayor of the City of
,leffersonville, or the timely override of his veto.
