Lanz, P.E. • INTERLOCAL AGREEMENT BETWEEN THE TOWN OF CLARKSVILLE, INDIANA AND THE CITY OF JEFFERSONVII~LE, INDIANA THIS AGREEMENT is entered into by and between the TOWN OF CLARRSVILLE, INDIANA, through its Town Council and other agencies and the CITY OF JEFFERSONVILLE, INDIANA, through its City Council and other agencies. WHEREAS, I.C. 36-1-7, et seq. authorizes a political subdivision in the State of Indiana to enter into Interlocal Agreements; and WHEREAS, the TOWN OF CLARRSVI7~LE, INDIANA and the CITY OF JEFFERSONVILLE, INDIANA are desirous of constructing an intercity roadway to link the two municipalities; and WHEREAS, such a roadway linking said municipalities will require participation of the respective Redevelopment. Commissions and Redevelopment Authorities of the two municipalities; and WHEREAS, the Redevelopment Commission of the CITY OF JEFFERSONVILLE, INDIANA is willing to be the lead authority for purposes of acting on behalf of both municipalities to initiate the necessary. documents to expedite the roadway project; IT IS, THEREFORE, HEREBY AGREED by the municipalities herein as follows: I. DURATION: This AGREEMENT will be in effect for a period of three (3) years, subject to renewal for an additional like period pursuant to the mutual agreement of the parties, subject to amendment or renegotiation by the parties, and any property acquired will be disposed of pro rata upon termination of this AGREEMENT. II. PURPOSED AND SCOPE OF AGREEMENT: The purpose of this AGREEMENT is for the two municipalities to plan, finance and construct an intercity roadway linking the municipalities. III. NATURE OF SERVICES AND DUTIES: The Town Council and the other agencies of the • • TOWN OF CLARKSVILLE, INDIANA agree to cooperate with the City Council for the CITY OF JEFFERSONVILLE, INDIANA and its other agencies, and the Jeffersonville Redevelopment Commission agrees to act as the lead agency in securing the design, financing and in the construction of an intercity roadway linking the TOWN OF CLARR3VILLE, INDIANA and the CITY OF JEFFE1t3ONVILLE, INDIANA, and to serve. as Administrator of this AGREEMENT. IV. INTERLOCAL PROJECT LIMITS: The limits of the project extend from a point on the proposed Intercity Road approximately five hundred feet (500') west of I-65, the normal point of touchdown from the bridge over I-65, to the easterly right-of-way line of Hamburg Pike, for a total distance of approximately three fourths 3/4) miles. V. FINANCIAL PARTICIPATION: The municipalities hereby agree to share all costs associated with the design and construction of all parts of the road within • the Interlocal project limits equally, excepting the costs associated with right-of- way acquisition, which. will be the responsibility of each municipality within their respective boundaries. No real. property shall be jointly acquired.. Any financial support received for the project by the State of Indiana will be shared equally by the municipalities to offset the project's costa VI. MISCELLANEOUS: The financing, staffing and supplying of this AGREEMENT shall be undertaken and a joint budget shall be maintained by the Clerk- Treasurer of the CITY OF JEFFERSONVILLE and/or the Treasurer of the JEFFERSONVILLE REDEVELOPMENT COMMISSION, who will have the duty to receive, disperse and account for all monies. • This AGREEMENT is subject to and contingent upon the State of • Indiana proceeding with the widening of I-65 through the TOWN OF CLARKSVILLE, INDIANA and the CITY OF JEFFERSONVILLE, INDIANA, and the State of Indiana constructing, in addition, the feeder roadway system to run parallel to I-65 in the TOWN OF CLARRSVILLE, INDIANA and the CITY OF JEFFERSONVILLE, INDIANA. In the event that the State of Indiana fails to proceed with the aforesaid widening of I-65 and the construction of the feeder roadway system, then both parties agree that this may be terminated by either party on thirty (30) days written notice. In -the event that either municipality is unable and/or unwilling to provide adequate funding for this project and provides notice thereof to the other municipality, then the other municipality may terminate this agreement upon thirty (30) days written notice.
