HomeMy WebLinkAbout12-17-2007COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA December 17, 2007 The Common Council of the City of Jeffersonville, Indiana met in regular session in Room 101, City Hall, 500 Quartermaster Court, Jeffersonville, Indiana, at 7:30 P.M. on Monday December 17, 2007. Council President Fetz presented Councilperson John Perkins with a plaque of appreciation for serving 20 years without ever missing a meeting. Councilperson Perkins expressed his gratitude saying he was elected to serve and to serve one has to be present. Mayor Rob Waiz, with Clerk Treasurer Peggy Wilder at the desk, called the meeting to order. Also present were City Attorney Les Merkley and Deputy Clerk Treasurer Barbara Hollis. Mayor Waiz welcomed all in attendance, asking all those present to stand as Councilperson Samuel gave the invocation. Mayor Waiz then asked all those present to join him in the pledge of allegiance to the flag. The roll was called and those present were; Councilpersons John Perkins, Ed Zastawny, Connie Sellers, Keith Fetz, Barbara Wilson, Nathan Samuel, and Ron Grooms. Absent: None. Following discussion, Councilperson Samuel made the motion to approve the agenda with the addition of agenda item #20A, An Ordinance Amending An Ordinance, and agenda item #20B, A Resolution Creating The City Of Jeffersonville Insurance Committee, and changing the speaker to Councilperson Samuel for agenda items #17, #18, #19, and #20, second by Councilperson Wilson, passing on a vote of 7-0. Mayor Waiz presented the minutes for approval. Councilperson Wilson made the motion to approve the minutes of November 19, 2007 (7:30 P.M.) as presented, second by Councilperson Zastawny, passing on a vote of 7-0. Councilperson Wilson made the motion to approve the minutes of December 3, 2007 (7:30) as presented, second by Councilperson Zastawny, passing on a vote of 7-0. Councilperson Wilson then made the motion to approve the minutes of December 3, 2007 (5:30) as presented second by Councilperson Grooms, passing on a vote of 7-0. Following explanation, Council December 17, 2007 2 President Fetz made the motion to add a sentence on page 2 of the October 1, 2007 minutes, second by Councilperson Sellers passing on a vote of 7-0. Clerk Treasurer Wilder presented the claim list for consideration by the Council, explaining two additional claims. Following discussion, Councilperson Grooms made the motion to approve the claims with the additionals, changing the claim to Republic Credit Card in the Council budget for Boot Camp Registration to $300 to reflect payment for elected officials, second by Councilperson Samuel, passing on a vote of 5-0. PUBLIC COMMENT: Mr. Ron Smith, 3310 Holman Lane, appeared before the Council to express his appreciation for Mayor Waiz and all he has done, noting he played fair and got things done. Mayor Waiz sacrificed his own business and never asked for a pay raise. He has been an honest Mayor that has done a tremendous job. Mr. Mike Moore requested paving for the crossover on 10`h Street at First Baptist Church as there is a three-inch drop. Mayor Waiz will see this is taken care of. Mr. Larry Purcell noted problems at 1510 Mitchell Avenue. The house is empty, there are workers fixing the house at night. Sheds in the area have been broken into. There is need for a streetlight. He believes drugs are being sold. Mayor Waiz invited Mr. Purcell to the Board of Public Works meeting. Mr. R. Summers, referring to the proposed annexation, said he has heard it is a "win-win" situation, "a done deal", "it's a go". Mr. Summers said "It ain't over till its over". Mr. Derek Spence asked about the State of the Council address, saying he would like to bring it back. COUNCIL COMMENT: Councilperson Perkins noted Diane Swank has been working on the utility portion of the property and casualty insurance policy. Ms. Swank presented and explained a report that indicates the total share of the premium for the sewer department is $117,072.01. She will have health insurance numbers before the end of the year. Clerk Treasurer Wilder will present the claim to the Sewer Board. Other discussion followed. DEPARTMENT HEAD REPORTS: There were no Department Head reports. December 17, 2007 AGENDA ITEMS: 3 Ms. Beth Keeney, Redevelopment Executive Assistant, presented a request for tax abatement for MKM, introducing Ms. Lisa, Beauchemin, Controller. Ms. Keeney explained the favorable review. Following all discussion, Councilperson Perkins made the motion to pass Resolution No. 2007-R-41, A Resolution Approving Statement Of Benefits For Purposes Of Personal Property Tax Abatement, for five years, second by Councilperson Grooms, passing on a vote of 7-0. Councilperson Grooms made the motion to pass Ordinance No. 2007-OR-75, An Ordinance Of Additional Appropriation (EDIT Fund -Sidewalks) on the third reading, second by Councilperson Perkins, passing on a vote of 7-0. Councilperson Grooms made the motion to pass Ordinance No. 2007-OR-79, An Ordinance Transferring Certain Funds Within Same Department (Board of Public Works and Safety), on the second and third readings, second by Councilperson Perkins, passing on a vote of 7-0. Councilperson Grooms made the motion to pass Ordinance No. 2007-OR-80, An Ordinance Transferring Certain Funds Within Same Department (Common Council), on the second and third readings, second by Councilperson Perkins, passing on a vote of 7-0. Councilperson Grooms made the motion to pass Ordinance No. 2007-OR-81, An Ordinance Transferring Surplus Funds From The Cumulative Capital Improvement Fund To The General Fund, on the second and third readings, second by Councilperson Perkins, passing on a vote of 7-0. Ms. Billie Ann Durrett, INAAP Reuse Authority Controller, explained the need for passage of Resolution No. 2007-R-42, Third Amendment To The Interlocal Agreement On The River Ridge Joint Reuse Authority, F/K/A INAAP Reuse Authority. Following discussion, Councilperson Perkins made the motion to pass Resolution No. 2007-R-42, second by Councilperson Sellers, passing on a vote of 7-0. Councilperson Samuel explained the need for passage of Ordinance No. 2007- OR-83, An Ordinance Of Additional Appropriation (Motor Vehicle). Councilperson Samuel made the motion to suspend the rules for Ordinance No.2007-OR-83, second by Councilperson Sellers, passing on a vote of 7-0. Councilperson Samuel then made the December 17, 2007 4 motion to pass Ordinance No. 2007-OR-83 on all three readings, second by Councilperson Wilson, passing on a vote of 7-0. Councilperson Samuel explained the need for passage of Ordinance No. 2007- OR-84, An Ordinance Of Additional Appropriation (Sanitation). Councilperson Samuel made the motion to suspend the rules for Ordinance No.2007-OR-84, second by Councilperson Grooms, passing on a vote of 7-0. Councilperson Samuel then made the motion to pass Ordinance No. 2007-OR-84 on all three readings, second by Councilperson Wilson, passing on a vote of 7-0. Councilperson Samuel explained the need for passage of Ordinance No. 2007- OR-85, An Ordinance Of Additional Appropriation (Local Roads and Streets). Councilperson Samuel made the motion to suspend the rules for Ordinance No.2007-OR- 85, second by Councilperson Grooms, passing on a vote of 7-0. Councilperson Samuel then made the motion to pass Ordinance No. 2007-OR-85 on all three readings, second by Councilperson Wilson, passing on a vote of 7-0. Councilperson Samuel explained the need for passage of Ordinance No. 2007- OR-86, An Ordinance Of Additional Appropriation (General Fund). Councilperson Samuel made the motion to suspend the rules for Ordinance No.2007-OR-86, second by Councilperson Grooms, passing on a vote of 7-0. Councilperson Samuel then made the motion to pass Ordinance No. 2007-OR-86 on all three readings, second by Councilperson Wilson, passing on a vote of 7-0. Councilperson Perkins explained the need for passage of Ordinance No. 2007- OR-87, An Ordinance Amending Ordinance No. 2007-OR-63 That Established The Jeffersonville Common Council Special Non-Reverting Fund For Annexation Costs Incurred During 2008. Councilperson Perkins made the motion to suspend the rules for Ordinance No. 2007-OR-63, second by Councilperson Zastawny, passing on a vote of 7- 0. Councilperson Perkins then made the motion to pass Ordinance No. 2007-OR-87 on all three readings, second by Councilperson Wilson, passing on a vote of 6-1. Councilperson Samuel voted against passage. Councilperson Perkins explained the need for passage of Resolution No. 2007-R- 43, A Resolution Creating The City Of Jeffersonville Insurance Committee. Councilperson Perkins made the motion to pass Resolution No. 2007-R-42, second by December 17, 2007 5 Council President Fetz. Councilperson Zastawny likes the intent as more inclusion is good. The motion to pass Resolution No. 2007-R-43 passed on a vote of 6-1 with Councilperson Samuel voting in opposition. CLERK TREASURER COMMENTS: There were no Clerk Treasurer Comments. COMMITTEE REPORTS, COUNCIL AND MAYOR COMMENTS: Councilperson Samuel explained the no votes tonight were made as he had just received the information upon arriving at the meeting. Council President Fetz suggested he consider abstaining under the circumstances. Councilperson Grooms polled the incoming Council and has scheduled a swearing-in ceremony for Saturday, December 29, 2007. Notices will be included in employee's paychecks. There will be a meeting with Councilperson .Samuel, Councilperson Grooms, Council President Fetz, Attorney Larry Wilder, and City Judge elect Ken Pierce to discuss court costs. Councilperson Grooms expressed a sincere thank you to Councilperson Perkins for his years of service. Councilperson Grooms thanked Officer Grimes and Jeff High student Sperzel. Councilperson Grooms wishes all a Happy Holiday and Merry Christmas. Councilperson Wilson announced City Pride is out tonight judging homes. This has developed into a committee and she invites all to join. Councilperson Wilson wishes all a Happy Holiday and Merry Christmas. Councilperson Sellers ditto's the appreciation for Councilperson Perkins. She appreciates all he has done. Councilperson Perkins will be scheduling a training session soon for the Council Chambers equipment. He would like to respond to the public comment tonight by saying sometime free speech is not always correct. He defends Mr. Smith's right to speak. Rarely has he seen facts so misconstrued. Councilperson Perkins says thank you to all he served with on the Council. Councilperson Zastawny called attention to the appointment list. He suggests the retreat to be held next year be scheduled for a Saturday (January 19, January 26, or February 2). Councilperson Zastawny thanked Councilperson Perkins for his service to the City. He has enjoyed serving with him. December 17, 2007 6 Council President Fetz noted the Jeffersonville Methadone Clinic has been vacated. He asked if the parking lot is in use. January 1 recycling will be started in City Hall. Mayor Waiz noted there is recycling in the building. Council President Fetz anticipates having a tree giveaway to City residents in the spring using the $4,500 in the Tree Planting Fund. The State of the City address will come after the last meeting of 2007. Mayor Waiz said it has been an honor and a privilege to serve the City. He appreciates all the employees and Department Heads. On behalf of himself, Susan, Lena and Robert he wishes all a Merry Christmas and a Happy New Year.
