OF JEFFERSONVILLE, INDIANA

The Common Council of the City of Jeffersonville, Indiana met in regular session
', in~ oom 101, City Hall, 500 Quartermaster Court, Jeffersonville, Indiana, at 7:30 P.M.

'~ Council President Keith Fetz, with Clerk Treasurer Peggy Wilder at the desk,
', called the meeting to order. Also present were City Attorney Les Merkley, and Deputy
Clerk Treasurer Barbara Hollis. Council President Fetz welcomed all in attendance,
asking all those present to stand as Councilperson Grooms gave the invocation. Council
President Fetz then asked all those present to join him in the pledge of allegiance to the
flag.
The roll was called and those present were: Councilpersons John Perkins, Ed
Zastawny, Keith Fetz, Connie Sellers, Nathan Samuel, and Ron Grooms.
Absent: Councilperson Barbara Wilson.
', Following discussion, Councilperson Perkins made the .motion to approve the
agenda with the removal of agenda item #12, second by Councilperson Zastawny,
'' passing on a vote of 6-0.
Council President Fetz presented the minutes for consideration by the Council.
Councilperson Grooms made the motion to approve the minutes of September 17, 2007
(7:30 P.M.) with the correcting of the date and the correction of the word, word to World
', on page 2, second by Councilperson Sellers, passing on a vote of 6-0.
Clerk Treasurer Wilder presented the claim list for consideration by the Council,
', explaining two additional claims. Councilperson Perkins made the motion to approve the
claims and the two additional as presented, second by Councilperson Zastawny, passing
~' on a vote of 5-1. Councilperson Grooms voted against .passage. Council President Fetz
', is glad to see the claim for Tasers.
PURCHASE ORDERS TO BE APPROVED:
', No purchase orders were presented.

PUBLIC COMMENT:
Ms. Trish Roehm, 514 Camp Creek Road, Bethlehem, appeared before the
Council with several complaints regarding the Animal Shelter operation.
Ms. Bethany Mull, 2307 Arthur Street, Jeffersonville also voiced concerns
regarding the operation of the animal shelter. Her concern is the high number of "kills".
She would like to see more off-site adoptions.
'' An unidentified woman asked to make. comment and was told no as she had not
signed up. She then made several loud and derogatory comments at which point Council
President Fetz requested Police Officer Grimes to escort the woman from the room.
COUNCIL COMMENTS:
' Clerk Treasurer Wilder responded to the allegations regarding the animal shelter
by saying the State Board of Accounts has been very thorough reviewing the records at
the Animal Shelter. All is up to date and in order. She .feels the allegations made are
', irresponsible. There was an unfortunate .situation in the past. The State Board of
Accounts found no problems this year. Clerk Treasurer Wilder acknowledged her
Father-In-Law is the Director.
', Councilperson Perkins noted some volunteers think they need to be in charge.
', Groups have taken animals from the Shelter at a nominal charge and they have been
found on the Internet for .sale. The Council has done more than any in the State
', protecting animals. The Shelter does a .fantastic job. Some feel it should beano-kill
facility. This is a great goal, but not possible.
DEPARTMENT HEAD REPORTS:
Street Commissioner Ron Ellis appeared before the Council regarding the serious
situation with City equipment. A street sweeper is on its last leg. Two of the garbage
', trucks are worn out. Commissioner Ellis. answered questions regarding age and mileage
on the equipment. Commissioner Ellis requests the Council appropriate money for
equipment. Commissioner Ellis was asked toget specs for all requested equipment.

Councilperson Perkins reviewed,. the Interlocal Cooperation For Sanitary Sewer
Services, Water Service, And Surface Water. Drainage Service Agreement. Attorney

Merkley has reviewed the document and said it looks. fine. Councilperson Grooms raised
', several questions for discussion. At the .conclusion of all comments Councilperson
Perkins made the motion to table the agreement, second by Councilperson Sellers,
passing on a vote of 6-0.
Council President Fetz announced a public hearing for Ordinance No. 2007-OR-
S8, An Ordinance changing The Zoning Map Designation Of A Certain Tract Of Property
Described As Being Part Of Lot No. 8 In Block No. 33 In The City Of Jeffersonville, The
Same Being Forty Feet And 5 Inches Fronting On Meigs Avenue By One Hundred And
', Seventy Feet In Depth, And More Commonly Known As 415 Meigs Avenue,
', Jeffersonville, Indiana 47130, asking for public comment. Mr. Derek Spence spoke in
', favor of the Ordinance. Councilperson Sellers announced this was passed unanimously
at the Plan Commission. Councilperson Perkins noted this is a commercial area.
Councilperson Perkins then made the motion to pass Ordinance No. 2007-OR-58, second
', by Councilperson Sellers, passing on a vote of 6-0.
Clerk Treasurer Wilder explained the need for passage of Ordinance No. 2007-
', OR-59, An Ordinance Of Additional Appropriation (Gaming Revenue-Phone Systems-
Station #2, #4, Street/Maint. Complex). Councilperson Zastawny made the motion to
suspend the rules for Ordinance No. 2007-OR-59, second by Councilperson Sellers,
passing on a vote of 6-0. Councilperson Zastawny then made the motion to pass
Ordinance No. 2007-OR-59 on all three. readings, second by Councilperson Perkins,
passing on a vote of 6-0.
Clerk Treasurer Wilder next explained, the need for passage of Ordinance No.
2007-OR-61, An Ordinance Of Additional Appropriation (EDIT Fund - Floodwall Art).
Following discussion, Councilperson Samuel made the motion to pass Ordinance No.
2007-OR-60 on the first reading, second by Councilperson Sellers, passing on a vote of
6-0.
Clerk Treasurer Wilder explained the need for passage of Ordinance No. 2007-
OR-61, An Ordinance Of Additional Appropriation (General Fund -Clerk Treasurer
Budget). Councilperson Perkins made the. motion to suspend the rules for Ordinance No.
2007-OR-61, second by Councilperson Sellers, passing on a vote of 6-0. Councilperson

Perkins then made the motion to pass Ordinance No. 2007-OR-61 on all three readings,
second by Councilperson Zastawny, passing on a vote of 6-0.
Clerk Treasurer Wilder explained the need for passage of Ordinance No. 2007-
OR-62, An Ordinance of Tax Anticipation Warrants. Following discussion,
Councilperson Perkins made the motion to suspend the rules for Ordinance No. 2007-
OR-62, second by Councilperson Zastawny, passing on a vote of 6-0. Councilperson
Zastawny then made the motion to pass Ordinance No. 2007-OR-62 on all three readings,
second by Councilperson Sellers, passing on a vote of 6-0.
CLERK TREASURER COMMENTS:
Clerk Treasurer Wilder explained the ongoing audit has revealed Utility
expenditures that need to be reimbursed from Local Roads and Streets, TIF, and
Redevelopment funds. Attorney Merkley agreed these need to be made. Councilperson
Grooms made the motion to approve the appropriate transfers, second by Councilperson
Perkins, passing on a vote of 6-0. Clerk Treasurer Wilder reviewed a list of offices with
petty cash. Ordinances authorizing most of these accounts cannot be found. The Council
asked Clerk Treasurer Wilder to provide an Ordinance. Clerk Treasurer Wilder informed
the Council she might need more attorney fees as she has been personally sued.
', COMMITTEE REPORTS, COUNCIL AND MAYOR COMMENTS:
', Councilperson Grooms reported Councilperson Wilson has ordered candy for
Halloween Downtown. Colgate has donated toothbrushes and toothpaste. Councilperson
Grooms attended a book signing for a book entitled This Place We Call Home. This is a
great book about Clark County. Flu Shots will be given tomorrow. Councilperson
Grooms thanks Officer Grimes and Jeff High Student Sperzel.
', Councilperson Samuel announced Child Place Rally Day, inviting all to come.
', Councilperson Perkins noted he would offer a Resolution to allow the Clerk
Treasurer to move. appropriations as necessary toward the end of November or the first of
December. Councilperson Perkins noted public comment is very important. Some have
been abusive. This leaves a bad taste. Some mean well, but lose track of reality. He
noted Animal Shelter Director Wilder does a fine job. He feels the animals are treated
humanly. He is proud of the Animal Shelter. Attacks are out of place. He suggests the
Council consider limiting public comment to agenda items.

Councilperson Zastawny, referring to the Saturday meeting, urged all to work
toward setting defined lines between Jeffersonville_and Clarksville._
Council President Fetz referred to the weekend murders, noting the suspect has
turned himself in. He commends the Police. There is a need to provide the necessary
tools and equipment to provide safety to all.
