HomeMy WebLinkAbout10-15-2007 COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA October 15,2007 The Common Council of the City of Jeffersonville, Indiana met in regular session in Room 101, City Hall, 500 Quartermaster Court, Jeffersonville, Indiana, at 7:30 P.M. on Monday October 15,2007. Mayor Rob Waiz, with Clerk Treasurer Peggy Wilder at the desk, called the meeting to order. Also present were City Attorney Les Merkley, and Deputy Clerk Treasurer Barbara Hollis. Mayor Waiz welcomed all in attendance, asking all those present to stand as Councilperson Grooms gave the invocation. Mayor Waiz then asked all those present to join him in the pledge of allegiance to the flag. The roll was called and those present were; Councilpersons John Perkins, Ed Zastawny, Keith Fetz, Connie Sellers, Barbara Wilson, and Ron Grooms. Absent: Councilperson Nathan Samuel. Following discussion, Councilperson Perkins made the motion to approve the agenda with the removal of agenda item #15, #17, #19, #20, and #21, placing Ms. Sharon Marra, Solid Waste District, in agenda item # 15, second by Councilperson Sellers, passing on a vote of 6-0. Mayor Waiz presented the minutes for consideration by the Council. Councilperson Wilson made the motion to approve the minutes of September 19, 2007 (7:30 P.M.) as presented, second by Councilperson Zastawny, passing on a vote of 6-0. Councilperson Wilson made the motion to approve the minutes of September 29,2007 as presented, second by Councilperson Sellers, passing on a vote of 6-0. Councilperson Wilson made the motion to approve the minutes of October 1, 2007 (5:30 P.M.) as presented, second by Councilperson Grooms, passing on a vote of 6-0. Councilperson Wilson then made the motion to approve the minutes of October 1,1007 (7:30 P.M.) with one correction (Mayor Waiz was not in attendance), second by Councilperson Sellers, passing on a vote of 6-0. Clerk Treasurer Wilder presented the claim list for consideration by the Council, explaining four additional claims. Mr. Dustin White spoke on behalf of the claim October 15,2007 2 regarding the Commission On The Status Of Black Males. Councilperson Perkins made the motion to approve the claims and the four additional as presented, second by Councilperson Sellers, passing on a vote of 6-0. PURCHASE ORDERS TO BE APPROVE: No purchase orders were presented for approval. PUBLIC COMMENT: Mr. Don Herrold, Chaplain, VFW Post 1832, presented a POW-MIA flag to be flown in the front of City Hall. Ms. Jan Markert, and Ms. Shirley Munich declined to speak as the ZOnIng ordinance has been removed from the agenda. COUNCIL COMMENT: Councilperson Perkins said the Council is in the process of going high tech, explaining the system that is partially installed. Councilperson Grooms call upon Jeff High Student Sperzel for comment. Mr. Sperzel explained the audio failed during the taping of the October 1, 2007 meeting. DEPARTMENT HEAD REPORTS: There were no Department Head reports. AGENDA ITEMS: Mr. Mike Gillenwater, Attorney, representing Oak Park Conservancy District, explained Ordinance No. 2007-0R-64, Interlocal Cooperation For Sanitary Sewer Services, Water Service, And Surface Water Drainage Service Agreement. Councilperson Grooms made the motion to pass Ordinance No. 2007-0R-64 on the first reading, second by Councilperson Perkins. Council person Grooms is not comfortable with the 30-year agreement on page 2. He questions what are necessary and regular costs. The motion to pass Ordinance No. 2007-0R-64 on the first reading passed on a vote of 5-0-1. Council President Fetz abstained. Clerk Treasurer Wilder explained the need for passage of Ordinance No. 2007- OR-60, An Ordinance Of Additional Appropriation (EDIT Fund - Floodwall Art). Councilperson Zastawny made the motion to pass Ordinance No. 2007-0R-60 on the second and third readings, second by Councilperson Perkins, passing on a vote 6-0. October 15, 2007 3 Council President Fetz, referring to Ordinance No. 2007-0R-56, 1st Amended Campaign Finance Code, said he intends to ask Clark County and other municipalities to pass a similar Ordinance. Ethics Commission President Derek Spence explained the changes calling this a "clean up". Councilperson Perkins made the motion to suspend the rules for Ordinance No. 2007-0R-56, second by Council President Fetz, failing on a vote of 5-1. Councilperson Zastawny voted against suspension. Council President Fetz then made the motion to pass Ordinance No. 2007-0R-56 on the first and second readings, second by Councilperson Perkins, passing on a vote of 6-0. Councilperson Zastawny asked that paragraph A on page 7 be changed from 25 to 50 in order to be consistent. Ms. Sharon Marra, Director, Clark County Solid Waste, appeared before the Council with an Interlocal Agreement regarding recycling. Ms. Marra explained the changes noting the cost per resident will be no more than $34 a year. Council person Zastawny said this is good news. Councilperson Grooms explained the pricing. An additional $1.00 per ton will be charged on the tipping fee to go to the Solid Waste District. County Commission Mike Moore explained this would net about $180,000 per year. Councilperson Perkins made the motion to pass Ordinance No. 2007-0R-65 on the first reading, second by Councilperson Sellers, passing on a vote of 6-0. Councilperson Wilson explained the need for passage of Resolution No. 2007-R- 30, A Resolution To Advertise For An Additional Appropriation (EDIT - Street Lights). Councilperson Wilson made the motion to pass Resolution No. 2007-R-30, second by Councilperson Zastawny, passing on a vote of 6-0. Mr. Alan Applegate, Attorney representing BILDM, LLC, explained Ordinance No. 2007-0R-66, An Ordinance Granting Petition To Vacate Portion Of Drainage And Detention Basin Easement. Councilperson Sellers is uncomfortable passing this without the approval of the Drainage Board. Attorney Applegate explained the Drainage Board has given approval. Councilperson Perkins made the motion to suspend the rules for Ordinance No. 2007-0R-66, second by Councilperson Wilson, failing on a vote of 5-1. Councilperson Zastawny voted against suspension. Mayor Waiz announced this a public hearing asking for comment. No comment being heard, Councilperson Perkins made the motion to pass Ordinance No. 2007-0R-66 on the first and second readings, second by Councilperson Wilson, passing on a vote of 6-0. October 15, 2007 4 CLERK TREASURER COMMENTS: There were no Clerk Treasurer Comments. COMMITTEE REPORTS, COUNCIL AND MAYOR COMMENTS: Councilperson Grooms thanked Police Officer Grimes and Jeff High Student Sperzel for attending the meeting. Councilperson Perkins announced there would be a workshop scheduled for the use of the audio and visual equipment. Councilperson Zastawny does not understand the need to suspend the rules when there is no time sensitivity. Councilperson Grooms noted a need to appoint a chairperson for committee to review the proposal from Mr. O'Dell. The agreement was to appoint Councilperson Samuel to chair this committee. Council President Fetz thanked Mayor Waiz for the cooperation regarding the vehicle decals. Mayor Waiz wishes all a good night.
