referred to as "PERFORMER" and The City of Jeffersonville, County of Clark, IN,
referred to as "CLIENT."
i. CLIEN a rees to hire PERFORMER on $~~~ July 2007 &
Frida 2007 at the Terrace Lawn Jeffersonville IN from
6:00 to PM to perform fire arts and fire dancing, for a fee of
$3000.00 ($1500.00 per date).
II. This fee includes PERFORMER travel expenses.
III. PERFORMER will provide all necessary safety gear and personnel.
IV. PERFORMER will perform for forty-five minutes of each hour.
V. PERFORMER will arrive at the site by 5:15 PM on the performance
date(s) for set-up.
VI. CLIENT agrees to provide a performance space, no less than 300 ft2 (30
ft x 10 ft), free of obstructions and in a location so as not to impede the
flow of pedestrian traffic. PERFORMER retains the sole right to
determine the suitability of the site.
VII. CLIENT agrees to provide a source of clean water near the performance
space for use by the PERFORMER for the wetting of safety gear.
VIII. CLIENT agrees to provide an adequate amount of cold, potable drinking
water for consumption by the PERFORMER. This can include, but is not
limited to bottled drinking water.
ix. Cancellation, change of time or date, and any other changes to this
contract must be made at least five days in advance of the performance.
Full and complete payment must still be made if the CLIENT cancels the
performance with less than five days written notice.
x. Payment is to be made as follows: The CLIENT will provide the
PERFORMER a check made out to "Pandora's Matchbox LLC" for the
full amount ($1500.00) for the first performance, following the
performance. If the CLIENT wishes to retain the services of the
PERFORMER for the. second date, an additional, partially refundable
deposit of $500.00 will be required from the CLIENT at the completion of
the first performance, for a total of $2000.00. The balance of $1000.00 is
to be paid at the completion of the second performance. In the event of
cancellation of the second event, or if the CLIENT no longer wishes to
retain the services of the PERFORMER, five days advance notice must be
given in order to receive a refund of 50% of the deposit ($250.00).

XI. In the event of rain, the PERFORMER will make all good faith attempts
to fulfill the terms of the contract as defined in clauses IV and V.
Cancellation of the event due to rain or other "act of nature" constitutes
completion of the contract by the PERFORMER, resulting in full payment
by the CLIENT.
XII. Due to the nature and inherent risks of fire performance, the CLIENT
agrees to accept all "responsibility and liability" for any accidental injury
or damage of property that may occur as a result of the PERFORMER
fulfilling the above contractual obligations. "Responsibility and liability"
includes, but is not limited to ensuring that any accidental injury or
damage of property resulting from "fire arts and performance" is
allowable and covered under the insurance policy for the event. In the
event that accidental injury or damage of property resulting from "fire arts
and performance" is not covered under the insurance policy for the event,
the PERFORMER must be notified within five business days prior to the
event. The PERFORMER can provide insurance coverage for an
additional fee of $500.00 per performance.
By signing this contract, the CLIENT agrees that this contract is a binding
agreement and furthe agrees to meet the terms of the contract. This is a

within.
