HomeMy WebLinkAbout2007-OR-45ORDINANCE 2007-0R~~ AN ORDINANCE REQUIRING ALL JEFFERSONVILLE CITY OWNED VEHICLES TO DISPLAY VEffiCLE IDENTIFICATION STICKERS WHEREAS, IC 36-1-2~(3) designates the Common Council of the City of 7effersonville as the Fiscal Body of said city, and WHEREAS, IC 36-1-2-9(3) designates the Common Council of the City of Jeffersonville as the Legislative Body of said city, and WHEREAS, IC 36-1-3-3 states that if there is any doubt as to the existence of a power of a unit, the resolution shall be that this power exists, and WHEREAS, IC 36-1-3-4 states that a unit has all other powers necessary or desirable in the conduct of its affairs, even though not granted by statute, and WHEREAS, IC 36-4-6-18 grants the legislative body of a city, through the passage of ordinances, orders, resolutions, and motions the authority to control the city's property and finances, and WHEREAS, the Common Council of the City of Jeffersonville recognizes that the City of Jeffersonville owns, operates, and maintains a large fleet of motor vehicles, and WHEREAS, the Common council of the City of Jeffersonville now desires that ail City owned vehicles be readily identifiable to the citizens of Jeffersonville and the general public, and WHEREAS, The Common Council of the City of Jeffersonville now wishes to create a an ordinance requiring all city owned vehicles to display identification stickers, NOW, THEREFORE, LET IT BE ORDAINED BY THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE SECTION 1 Definition: Motor Vehicle means a vehicle that is self-propelled with provisions for the transport of an operator, including mowing machines, earth moving equipment, and any other self-propelled instruments used in the maintenance and. upkeep of land. SECTION 2. All motor vehicles owned, operated, leased, and/or maintained by the City of Jeffersonville shall readily display markings in th~form of minimum seven (7) inch decals identifying the vehicle as being a Jeffersonville City vehicle. SECTION 3. This ordinance shall apply to all city owned vehicles mentioned above with the exception of unmarked police vehicles to be used by the Jeffersonville Police department. SECTION 4. This ordinance shall be enforced without exception. No employee shall continue to drive a city owned vehicle that is not properly marked per this ordinance. Non compliance of this ordinance by any person in control of said city owned vehicle shall cause said person to forfeit the use of said vehicle. SECTION 5 Auy existing ordinance, or section(s) of existing ordinances that are in conflict with this ordinance are hereby repealed. This ordinance shall be in full force and effect after passage by the Common Council of the City of Jeffersonville and approval by the Mayor of the City of Jeffersonville, or the timely ovemde of his veto.
