COUNCIL PROCEEDINGS OF THE
COMMON COUNCIL OF THE CITY
OF JEFFERSONVILLE, INDIANA
August 6, 2007
The Common Council of the City of Jeffersonville, Indiana met in regular session
in Room 101, CitY Hall, 500 Quartermaster Court, Jeffersonville, Indiana, at 7:30 P.M.
on Monday August 6, 2007.
Mayor Rob Waiz, with Clerk Treasurer Peggy Wilder at the desk, called the
meeting to order. Also present were City Attorney Les Merkley, and Deputy Clerk
Treasurer Barbara Hollis. Mayor Waiz welcomed all in attendance, asking all those
present to stand as Street Commissioner Ron Ellis gave the invocation. Mayor Waiz then
asked all those present to join him in the pledge of allegiance to the flag.
The roll was called and those present were; Councilpersons John Perkins, Ed
Zastawny, Keith Fetz, Connie Sellers, Barbara Wilson, Nathan Samuel, and Ron Grooms.
Absent: None.
Following discussion, Councilperson Perkins made the motion to approve the
agenda with the addition of agenda item # 11 A, an Ordinance Creating Agricultural
Zoning, second by Councilperson Zastawny, passing on a vote of7-0.
Mayor Waiz presented the minutes for consideration by the Council.
Councilperson Wilson made the motion to approve the minutes of July 16, 2007 (7:30
P.M.) as presented, second by Councilperson Grooms, passing on a vote of7-0.
Clerk Treasurer Wilder presented the claim list for consideration by the Council.
Council person Perkins made the motion to approve the claims as presented, second by
Councilperson Sellers. Councilperson Samuel made the motion to amend the motion to
remove the claim for Burnham & Flowers, second by Councilperson Grooms, failing on a
vote of 2-5. Councilpersons Perkins, Zastawny, Fetz, Sellers, and Wilson voted against
the amendment. The motion to approve the claims as presented passed on a vote of 5-2.
Councilpersons Grooms and Samuel voted against passage. Councilperson Grooms feels
the insurance is a professional service that should be handled by the executive branch.

PURCHASE ORDERS TO BE APPROVED:
Clerk Treasurer Wilder will present Parks Department purchase orders later this
week.
PUBLIC COMMENT:
Mr. Charlie Milburn, 22 Linden Road spoke against annexation. Mr. Milburn
feels the government is tearing the country apart. Government should not worry about
what is good for business; government should worry about what is good for people.
Ms. Heather White and Ms. Tiffany Martin asked Mayor Waiz why Bev Knight
has been removed from her position, asking she be brought back. Mayor Waiz suggests
they contact Justin Campbell. He will be happy to talk with Ms. White and Ms. Martin.
Mr. R. Summers, Indian Hills, again asked all to reconsider annexation and the
Mayor to veto annexation.
Mr. James Tolle, 4101 Patricia Drive, stated he is completely against annexation.
He does not see what annexation can give him. He hopes all do not run again.
AGENDA ITEMS:
Councilperson Perkins presented and explained Ordinance No. 2007-0R-43, State
Of Indiana Plan Commission Recommendation To Jeffersonville Common Council To
Amend Portions Of The Jeffersonville Zoning Ordinance 2000-0R-61. Councilperson
Perkins made the motion suspend the rules for Ordinance No. 2007-0R-43, second by
Councilperson Sellers, passing on a vote of 7-0. Councilperson Perkins then made the
motion to pass Ordinance No. 2007-0R-43 on all three readings, second by
Councilperson Sellers, passing on the following roll call vote.
Ayes: Councilpersons Perkins, Zastawny Sellers, Wilson, Grooms, and Sellers.
Nays: None.
Abstain: Council President Fetz.
Councilperson Perkins read aloud amendments to Ordinance No. 2007-0R-I0,
An Ordinance Annexing Certain Real Estate Into The City Of Jeffersonville, Indiana.
Councilperson Perkins made the motion to pass Ordinance No. 2007-0R-I0 as amended,
on the second and third readings, second by Councilperson Zastawny. Councilperson
Grooms considers annexation a merger. The issue is quality of life. It will allow for

growth and improvement. There will be some adjustment to taxes. He referred to the
annexation of the Meadows and Veterans Parkway. Annexation will provide better
police protection, and fire protection. There will be elected officials from the area. It
will allow for upgrading sewer systems for a better public health. He hopes in 10 years
all will say it was a wise choice. Reviewing the number of different levels of government
representation, Councilperson Grooms said there might be a need for redistricting for a
more balanced representation. Ordinance No. 2007-0R-10 as amended, passed on the
following roll call vote.
Ayes: Councilpersons Samuel, Grooms, Wilson Sellers, Zastawny, and Perkins.
Nays: Council President Fetz.
Planning and Zoning Director Chester Hicks reviewed the need for passage of
Ordinance No. 2007-0R-40, An Ordinance Of Additional Appropriation (Major Moves-
Greenway Bank Stabilization). Councilperson Perkins made the motion to pass
Ordinance No. 2007-0R-40 on the second and third readings, second by Councilperson
Sellers, passing on a vote of 7 -0.
Mr. Ian Koffler, representing MKM Machine Tool Co., Inc. requested passage of
Ordinance No. 2007-0R-44, An Ordinance Authorizing The Entry Into A Lease-Sublease
Purchase Agreement In An Aggregate Principal Amount Not To Exceed $5,500,000 With
Chase Equipment Leasing Inc. And MKM Machine Tool Co. Inc.; To Finance The
Equipping Of An Economic Development Facility Located Within The City Of
Jeffersonville, Indiana; Authorizing A Lease-Sublease Purchase Agreement And Tax
Exemption Certificate And Tax Regulatory Agreement; And Authorizing Other Actions
In Connection With The Transaction. City Attorney Merkley explained the Ordinance.
Council President Fetz noted several outstanding fines for false alarms. He would
appreciate Mr. Koffler looking into these. Councilperson Perkins made the motion to
suspend the rules for Ordinance No. 2007-0R-44, second by Councilperson Zastawny,
passing on a vote of 7-0. Councilperson Perkins then made the motion to pass Ordinance
No. 2007-0R-44 on all three readings provide the fines are cleared up, second by
Councilperson Sellers, passing on a vote of7-0.
CLERK TREASURER COMMENTS:
There were no Clerk Treasurer Comments.

COMMITTEE REPORTS, COUNCIL AND MAYOR COMMENTS:
Councilperson Samuel inquired about the issues with Jefferson Trailer Park, the
Quarry, and the Mellwood drainage problems. Councilperson Samuel then asked about
the audiovisual equipment for the meeting room. Council person Perkins said it is on
order and would be installed in four to five weeks. Attorney Merkley reported the Quarry
problems are being addressed. Mayor Wais reported a public meeting was held.
Councilperson Perkins questions if the quarry is zoned properly for an asphalt plant.
Councilperson Grooms said a Solid Waste meeting is scheduled for August 16.
Proposals to continue recycling will be considered.
Councilperson Wilson reminded all to come to the Concerts In The Park.
Council person Perkins referred to City Council Attorney Greg Fifer. Attorney
Fifer introduced Mr. Mike Gillenwater, Attorney representing Oak Park Conservancy.
He recommends the Council pursue an interlocal agreement, suggesting a committee be
formed for this. Councilperson Perkins noted he has participated in prior annexation. He
agrees with Council person Grooms that merger would be a better word. Due diligence
has been done on this annexation. Annexation is like childbirth; painful with great
rewards. Councilperson Perkins thanks Phil McCauley for all his work.
Councilperson Zastawny asked Mayor Waiz for the status of Duffy's Landing.
Mayor Waiz referred to Park Superintendent Rob Poff. Superintendent Poff said he is
waiting for the final permit. The current docks should be demolished in two weeks. It
will take four to six weeks for the new docks. Councilperson Zastawny said the impact
of annexation couldn't be overstated. He is comfortable with the process, the community
presentation, and the numbers have been diligent. This annexation could decide the
future of Jeffersonville.
Mayor Waiz requests lower admissions to the Aquatic Center due to the heat
wave. Councilperson Perkins made the motion to lower the admission to the Aquatic
Center to $1.00 for all thru Sunday (August 12), second by Councilperson Wilson,
passing on a vote of 7-0. Mayor Waiz said the Ken Ellis Center would be open for relief
from the heat. Councilperson Perkins suggests cold drinks be made available. Mayor
Waiz promoted the Riverstage performance of Footloose.
