COUNCIL PROCEEDINGS OF THE
COMMON COUNCIL OF THE CITY
OF JEFFERSONVILLE, INDIANA
July 2, 2007
The Common Council of the City of Jeffersonville, Indiana met in regular session
in Room 101, City Hall, 500 Quartermaster Court, Jeffersonville, Indiana, at 7:30 P.M.
on Monday July 2, 2007.
Mayor Rob Waiz, with Clerk Treasurer Peggy Wilder at the desk, called the
meeting to order. Also present were City Attorney Les Merkley and Deputy Clerk
Treasurer Barbara Hollis. Mayor Waiz welcomed all in attendance, asking all those
present to stand as Councilperson Grooms gave the invocation. Mayor Waiz then asked
all those present to join him in the pledge of allegiance to the flag.
The roll was called and those present were; Councilpersons John Perkins, Ed
Zastawny, Keith Fetz, Connie Sellers, Barbara Wilson, and Ron Grooms.
Absent: Councilperson Nathan Samuel.
Following discussion, Councilperson Perkins made the motion to approve the
agenda with the addition of agenda item #13A, Ordinance No. 2007-0R-27, 13B
Resolution to Advertise for an Additional Appropriation, 13C, An Ordinance Amending
The Tap In Ordinance, and 13D, An Ordinance regarding Skateboarding, second by
Councilperson Sellers, passing on a vote of 6-0.
Mayor Waiz presented the minutes for consideration by the Council.
Councilperson Wilson made the motion to approve the minutes of June 14, 2007 (7:30
P.M.) with two corrections (the date in the first paragraph and the spelling change on
page 5 from Ronnie to Romney), second by Councilperson Perkins, passing on a vote of
6-0. Councilperson Wilson made the motion to approve the minutes of June 18, 2007
(7:30 P.M.) as presented, second by Council President Fetz, passing on a vote of6-0.
Clerk Treasurer Wilder presented the claim list for consideration by the Council,
explaining three additional claims. Councilperson Perkins called attention to the EDIT
claims for painting and paint for the Riverstage, as the Purchase Order procedure for
these was not followed. Clerk Treasurer Wilder explained she has included these on the
claim list for special consideration upon the request of Councilperson Grooms.

Councilperson Perkins said Department Heads have been warned that the purchase order
policy must be followed. The Park Superintendent is in the wrong and he feels the
Council would also be in the wrong and would violate the policy if these claims were
approved. Councilperson Perkins then made the motion to pay the claims along with the
additional, eliminating the painting and the paint. Councilperson Zastawny asked what
would happen if the policy is not followed. Councilperson Perkins feels the Department
Head is liable for payment. Councilperson Perkins feels the Council should "say what
they mean and mean what they say". Mayor Waiz does not feel this was intentional.
Clerk Treasurer Wilder feels there was an attempt to circumvent the policy. Council
President Fetz made the second to Councilperson Perkins's motion. The motion failed on
a vote of 2-4. Councilpersons Zastawny, Sellers, Wilson, and Grooms voted against
passage. Councilperson Grooms then made the motion to approve the claims as
presented with the addition of the three presented by Clerk Treasurer Wilder.
Councilperson Zastawny does not feel the action by the Park Superintendent was done
out of disrespect. Clerk Treasurer Wilder related several incidents where the Parks
Department has not followed the rules. Council President Fetz said the intent of the
policy is to allow for a better form of government. Councilperson Perkins requested that
Superintendent Poff be asked to come to the next Council meeting. Councilperson
Perkins noted the Council has the authority to pay claims, asking how the Council can
authorize payment when the process is contrary to the Purchase Order Ordinance. City
Attorney Merkley's opinion is that the Council may pay the claims and it would be up to
the Council to recoup the money from the Department Head. Councilperson Fetz would
like to have vendors notified of the purchase order policy. Councilperson Wilson made
the second to Councilperson Grooms motion. The motion passed on a vote of 4-2.
Councilpersons Perkins and Fetz voted against passage.
PURCHASE ORDER TO BE APPROVED:
There were no purchase orders presented for approval.
PUBLIC COMMENT:
Mr. Dustin White, representing the Jeffersonville Commission on the Social
Status of Black Males, gave a report of programs and activities. Four students are with

him tonight to have a look at local government. The group is making progress with 25
high school students and 30 middle school students.
COUNCIL COMMENTS:
There were no Council comments at this time.
DEPARTMENT HEAD REPORTS:
There were not Department Head reports at this time.
AGENDA ITEMS:
Councilperson Perkins presented and explained Ordinance no. 2007-0R-35, An
Ordinance Of Additional Appropriation (General Fund-Common Council-Cell Phones).
Councilperson Perkins made the motion to suspend the rules for Ordinance No. 2007-
OR-35, second by Councilperson Sellers, passing on a vote of 6-0. Councilperson
Perkins then made the motion to pass Ordinance No. 2007-0R-35 on all three readings,
second by Councilperson Zastawny, passing on a vote of 6-0.
City Attorney Merkley presented and explained Resolution No. 2007-R-23, A
Resolution To Advertise For An Additional Appropriation (General Fund-Law
Department - Litigation Expenses). Following discussion, Council President Fetz made
the motion to pass Resolution No. 2007-R-23, second by Councilperson Sellers, passing
on a vote of 6-0.
Planning and Zoning Director Chester Hicks explained the need for passage of
Ordinance No. 2007-0R-28, An Ordinance Amending Portions Of Ordinance No. 96-
OR-28. Councilperson Perkins made the motion to pass Ordinance No. 2007-0R-28 on
the third reading, second by Councilperson Zastawny, passing on a vote of 6-0.
Planning and Zoning Director Chester Hicks next presented and explained
Resolution No.2007-R-36, A Resolution To Advertise For An Additional Appropriation
(Major Moves-Riverbank Stabilization). The lighting for the Greenway project was
discussed. Councilperson Perkins made the motion to pass Resolution No. 2007-R-24,
second by Councilperson Sellers, passing on a vote of 6-0.
Council President Fetz presented and explained the need for passage of Ordinance
No. 2007-0R-36, An Ordinance Amending The Tap In Ordinance. Following all
discussion, Council President Fetz made the motion to pass Ordinance No. 2007-0R-36
on the first reading, second by Councilperson Zastawny, passing on a vote of 6-0.

Councilperson Sellers presented and explained Ordinance No. 2007-0R-37, An
Ordinance Regarding Skateboarding, Councilperson Sellers made the motion to pass
Ordinance No. 2007-0R-37 on the first reading, second by Councilperson Zastawny,
passing on a vote of 6-0.
CLERK TREASURER COMMENTS:
Clerk Treasurer Wilder noted the need to set the budget workshop calendar.
Following discussion, it was decided to meet July 30, July 31, August 1, and August 2,
2007 at 5 :30 P.M.
COMMITTEE REPORTS, COUNCIL AND MAYOR COMMENTS:
Councilperson Grooms will present the claim for the Boys and Girls Club at the
next meetings. He has attempted to contact Jeff High Student Sperzel regarding
videotaping the meeting. Councilperson Grooms reminds the Council that curbside
recycling will cease in January 2008 unless other arrangements are made. Councilperson
Grooms thanked Police Officer Rusty Settles for his attendance this evening. A
discussion was held regarding the charge for fire hydrant rental.
Councilperson Wilson invites all to the Concerts In The Park. This Friday the
Military Bank will perform. The Council will participate in the July 4 Parade.
Councilperson Zastawny asked about the two-mile fringe meeting. Attorney
Merkley will set it up. Councilperson Zastawny agrees recycling needs to be thought
about.
Councilperson Perkins reported on an IACT and State Board of Accounts budget
workshop he attended. An excess levy appeal should be on the Form 4-B of the 2008
budget. The levy increase allowed will be 3.7%. Councilperson Perkins reminded of all
the public hearing scheduled for July 5, 2007 is a hearing and not a debate.
Councilperson Zastawny does agree however he feels misleading information should be
clarified.
Council President Fetz asked if the driveway ramp letter has been sent. He also
asked about vehicle stickers.
Mayor Waiz noted the Riverstage program is good urging all to try to make it
down. It is a good time. Mayor Waiz wishes all a good night.
