HomeMy WebLinkAboutPC AUGUST 27,2019 MINUTES OF THE JEFFERSONVILLE PLAN COMMISSION August 27, 2019 Call to Order Chairperson, Mr. McCutcheon, called the meeting of the Jeffersonville Plan Commission to order at 6:01 p.m. in the City Council Chambers,Jeffersonville City Hall, 500 Quartermaster Court,Jeffersonville, Indiana. Roll Call Members present were: Duard Avery, Chris Bottorff, Dustin White and Mike McCutcheon. Those members not present: Kathy Bupp, Ron Ellis, and Lisa Gill. Also present were Nathan Pruitt- Planning&Zoning Director, Les Merkley- Planning &Zoning Attorney, Ashley Woolsey- Planning& Zoning Coordinator and Peggy Hardaway- Secretary. (Secretary's Note: All plat maps, photos,etc. presented before the Plan Commission on this date can be found in the office of Planning and Development.) Approval of Minutes: Minutes were received in Plan Commission office but due to an oversight they were not forwarded to members; no action taken on July 23, 2019 minutes. Approval of Docket: Request by Speedway attorney to table items PC-19-42 Medication Agreement Approval (Speedway) and PC-19-39 Development Plan Approval (Speedway). Mr. White made the motion to "indefinitely table" the two items; motion failed for a lack of a second. Mr. White made a motion to approve the tabling of the two items; seconded by Mr. Bottorff and motion passes 4-0. Approval of Findings of Fact: Public Hearing Docket: Old Business: None New Business ZO-19-05 Sign Code Revisions Representation: Chad Reischl, City of Jeffersonville Planning Staff The Planning &Zoning Department recommends the following amendments to the City of Jeffersonville Zoning Ordinance (commercial and non-commercial signs). The update includes amendments to: 1. Article 7.17: General Sign Standards—changes due to new court ruling "content neutral" 2. Article 7.18:Temporary Sign Standards—allow two times per year for 30 days each in commercial district 3. Article 7.19: Permanent Sign Standards—combined districts 4. Article 10.6: Non-Conforming Signs 5. Article 10.7: Registration of Non-Conforming Signs- removed 6. Article 14.2: Definitions of Words Mr. White—how does this deal with 4 X 8 political signs in people's yards? Mr. Reischl—they are regulated by Indiana Code. Mr. White—is there anything in there about who, for example if I am renting property and I have a political sign is there anything in here about if the landlord can tell me if I can have it or not? Mr. Reischl—no, there is nothing in here about that. Page 1 of 4 Jeffersonville Plan Commission Meeting—August 27, 2019 Mr. Bottorff—does the temporary signs going from one to two per year—does that meet the needs of the business community? Mr. Reischl—I do get quite a few requests; say when a store is opening, they want a coming soon, and a now open sign. But we currently can only permit one sign for 30 days per year. I also get requests from businesses that have a summer clearance sale and winter sale; and it also makes it hard for an apartment complex who may want to put now leasing just once per year. Mr. Bottorff—was there any discussion about increasing the frequency more than twice a year? Mr. Reischl—I don't know if we want businesses coming to us having a temporary sign every month of the year. This was to make it a little easier. PC-19-43 Rezoning Rodilio Gomez Rogel and Alejandra Perez filed a request for rezoning for an approximately 6,000 sq. ft. property located at 2005 Woodland Court.The request is from IS to R3 high density residential. The property currently contains a single-family home that may, at one time, have been part of the church property next door (which would explain the institutional zoning).The current owners of the home are looking to build a new carport on the property, but are not able to do so under the rules set forth in the IS zone district. No representation present. Public Comment: support—none; against—none Board questions: none Mr. Avery made the motion to send a favorable recommendation to the City Council, seconded by Mr. Bottorff and motion passes 4-0. PC-19-44 Rezoning Request Mike Leonard filed a rezoning application for property located at 927 Indiana Avenue. The current zoning is C2 medium to large scale general commercial. The proposed rezoning request is for Cl small to medium scale commercial. Representation: Mike Hill - Planner with Land Design & Development 503 Washburn Avenue Louisville with Mike Leonard Hogan Real Estate. • Adding a piece (1/2 acre) to the Jeffersonville Gateway Development • For consistency in the development • Development plan to be present in the future Public Comments: support—none; against—none Calls, letters: None Mr. White made the motion to send a favorable recommendation to the City Council, seconded by Mr. Bottorff, motion passes 4-0. PC-19-45 Rezoning Request Wesley Johnson Jr filed a rezoning application for 1.8 acre property located at 715 W. Riverside Drive.The current zoning is Cl (Sm-Med Scale Commercial) and the former use was a restaurant. The proposed zoning change to M2 multi-family residential in order to build a riverfront residential development. Representation: Alan Applegate, Applegate, Fifer, Pulliam 428 Meigs Avenue Jeffersonville We represent Rocky's and KJ Development who are affiliated entities on this project. • 32 unit townhomes (PC-19-45 and PC-19-46 $20 million investment) not dense, above high water mark; with parking for each unit and carport under unit • Retained -Carman (civil engineering landscape architectural company) • Retained—EOP Architects Page 2 of 4 Jeffersonville Plan Commission Meeting—August 27, 2019 • 2.158 acres with very nice streetscape John Carman 400 East Main Street Louisville—retained a full team of multi- discipline consultants so that we fully understood the complexity of this project. Kevin Gough EOP Architects 300 East Main Street Louisville—the riverside development will have height restrictions on the property so we do not impede the views for both the Sheraton and Harbors Condominiums. Public comment: support—none; against- none Calls/letters: contact from the Harbor's Board comments: Mr.Avery—this follows the City Comprehensive Plan and I am very impressed with how this fits in the area. Mr. White—will this be taking away parking in the Buckhead/Rocky's area? Mr. Applegate—a few. Mr. White made the motion to send a favorable recommendation to City Council, seconded by Mr. Bottorff and motion pass 4-0. PC-19-46 Rezoning Request Wesley Johnson Jr filed an application request rezoning for two parcels of land on the block bounded by Market St., S. Indiana Ave., Riverside Dr. and the 2nd St. viaduct. The parcels are separated by the Jeffersonville flood wall. The parcel north of the flood wall is 0.32 acre; the parcel to the south is 0.33 acre.The developer would like to rezone both properties to DC in order to build a multi-family residential structure with parking encompassing the street level of the building. The property is currently zoned Cl small to medium scale general commercial. The proposed zoning is DC downtown commercial. We fully support the staff's recommendation of enhancing pedestrian experience along the streetscape between the two properties so that this district has a more vibrant pedestrian feel. We will be using durable materials, not stone and brick language; but a lighter more modern character because of the elevated structure. Mr. White made the made to send a favorable recommendation to City Council, seconded by Mr. Bottorff and motion passes 4-0. Mr. Pruitt—this is a big step going forward, we adopted the downtown residential overlay district some time ago that set a new vision for downtown properties to get a little more density in household counts which contributes to commercial development to come. Staff is happy to see new things coming. PC-19-47 Development Plan Approval Rob Waiz for the City of Jeffersonville filed a development plan application for property at 201 Willinger Lane. The property is zoned C2 medium to small scale general commercial. The proposed development is a proposed expansion to an existing animal shelter and adoption center. The applicant is requesting waivers for landscape. Representation: Louis Seidel with TG Architects 903 Spring Street Jeffersonville • 810 square foot kennel addition and refurbish the existing building • New sanitary sewer line—the plan will be redesigned after discussion with Waste Water Dept • Will match existing building profile • Minimum landscaping—9 not within 10 feet • Perimeter landscaping—0 provided • Parking lot—not screened Page 3 of 4 Jeffersonville Plan Commission Meeting—August 27, 2019 Public Comment: support—none; against—none Letter/calls: none Board questions: Mr. Avery—I would like to complement the City administration for saving this historic building with expanding and upgrading; as well as cost effective, but also enhancing the existing building. Mr. White made the motion to approve the development plan with waivers, seconded by Mr. Bottorff and motion passes 4-0. BOARD COMMENTS: Reports from Director and Staff: Mr. Pruitt—we will have several development plans for next month.
