JEFFERSONVILLE PLAN COMMISSION
February 26,2019
Call to Order
Chairperson, Mike McCutcheon, called the meeting of the Jeffersonville Plan Commission to order at 6:03
pm in the City Council Chambers,Jeffersonville City Hall, 500 Quartermaster Court,Jeffersonville, Indiana.
Roll Call
Members present were: Duard Avery, Chris Bottorff, Ron Ellis, Lisa Gill, and Mike McCutcheon. Those
members not present: Kathy Bupp and Dustin White. Also present were Nathan Pruitt, Planning &Zoning Director,
Les Merkley, Planning &Zoning Attorney, Ashley Woolsey, Planning&Zoning Coordinator and Peggy Hardaway,
Secretary.
(Secretary's Note: All plat maps, photos,etc. presented before the Plan Commission on this date can be found in
the office of Planning and Development.)
Approval of Minutes
Motion made by Ms. Gill to approve the January 29, 2019 Minutes, seconded by Mr. Bottorff and motion
passes 5-0.
Approval of Docket
Staff requested to move item 1 under new business to the end of the docket (and change to the item
number: should be ZO-19-03). Staff would also like to table item 7, PC-19-08. Ms. Gill made the motion to approve
the docket with staff request tabling PC-19-08 and moving ZO-19-03 to the end of the docket, seconded by Mr. Ellis
and motion passes 5-0.

PC-19-03 DEVELOPMENT PLAN APPROVAL
Nate Thompson filed a development plan application for property at 3549 East Tenth Street. The property is
zoned C2-PD which is a planned development in Jeffersonville Commons. The proposed development is a fast food
restaurant with drive-thru. The applicant is requesting waivers regarding setbacks and landscaping. The applicant
also filed a Development Standard Variance application.
David Nicklies, Nicklies Development 6060 Dutchmans Lane Louisville with Allan Wiley, engineer representing
Chick-Fil-A. Start in June and open in January 2020.
• Maximum building setback—Tenth Street-89.46 foot
• Minimum landscaping-waiver to plant foundation plantings more than 10 foot from building
• Perimeter landscaping—south side—zero trees
• Parking lot landscaping—zero on southern internal PD property line

• Parking setback — Tenth Street 43 foot; Herb Lewis 79 foot; Jeffersonville Common Drive 3 foot;

Public comment: support—none; against: none; close public comment.
Board Comments: Ms. Gill—please explain the landscape because there are several waivers requested.
Mr. Wiley — we have limited space for foundation plantings because Chick-Fil-A has a lot of sidewalk around their
buildings with the drive thru area clear for pedestrian foot traffic for safety. Outside employees with cash carts will
be placed around the drive thru to take payments in an effort to keep traffic moving. We are hoping that our
neighbor will add planting on the property line.
Ms. Gill made the motion to approve the development plan, second by Mr. Bottorff and motion passes 5-0.
PC-19-04 PRELIMINARY PLAT
Land-Mill Developers filed a Preliminary Plat application for approximately 25 acres of property located off
Charlestown Pike, which will be subdivided into 100 single family lots, Red Trail Ridge.The property is zoned R3 (Old
City Residential)
David Blankenbeker 618 East Court Avenue Jeffersonville with Greg Lander, Dave Miller and Eddie of Land-
Mill Developers
• Per Staff recommendation we added a stub street on Osprey
• Additional 41 off street dedicated parking (no on street parking)
Public Comments: against—none, support—none
Board Comments: Mr. Ellis — Charlestown Pike has a lot of traffic and people who already live there has
issues getting in and out of their drive way. Mr. Blankenbeker—there will be road frontage on the entrance and we
are dedicating land to the City for road improvements and a setback for turns, and no house will have a drive way on
Charlestown Pike. Mr. Bottorff—there is only one ingress/egress? Mr. Blankenbeker—yes, one reason for adding
the additional stub street. Mr. Pruitt — thanks to the developers for taking our comments to how important on
street parking can be. Mr. Blankenbeker—we will have sidewalks with connectivity as well. Mr. Pruitt—as we build
we will face traffic challenges which is the City's responsibility.
Ms. Gill made the motion to approve the preliminary plat, second by Mr. Ellis and motion passes 5-0.
PC-19-05 PRELIMINARY PLAT
Michael Guthrie filed a Preliminary Plat application for approximately 8.496 acres of property located of
Highway 62 & Water Tower Circle, which will be subdivided into four lots. The property is zone HC (Highway
Commercial)
Mr. Blankenbeker 618 East Court Avenue with Michael Guthrie and Michael Gillenwater
• The Guthrie's have an option to purchase this property from the Shepards
• Four large lots: 1.4 to 2.9 acre
• Guthrie's have a letter of intent on that property for a large hotel. Estimated to increase the City's
evaluation $16 million on the one lot. With maybe an overall $30 million of new assessed valuation
for the City. We believe a very good project for the City.

Ms. Gill the motion to approve the preliminary plat, second by Mr. Bottorff and motion passes 5-0.
PC-19-06 REZONING REQUEST
Patrick O. Broderick filed a rezoning application for .17 acres parcel of property located at 1002 East Tenth
Street. The current zoning is R3 (Old City Residential) and the proposed zoning is NC (Neighborhood Commercial).
Lee Myers 1300 Eastern Parkway Louisville -AGC representing Patrick Broderick and AGC Ventures purchased
the property with plans to revamp property inside making it completely handicap accessible for commercial lease.
Public comment: support—none; against—none
Board Comments: Ms. Gill-this property is surrounded by commercial properties and will be a good fit.

Ms. Gill made the motion to pass on to City Council a favorable recommendation, seconded by Mr. Bottorff,
and motion passes 5-0.
PC-19-07 REQUEST FOR FINAL PLAT APPROVAL
Brandon Denton filed a Final Plat application for approximately 8.24 acres of property located near the
intersection of Highway 62 and Gottbrath Parkway. The Final Plat's boundaries have changed slightly from the
Preliminary Plat and a Final Plat that were previously approved. Due to this change, the plat is not approvable by
Planning Staff and requires Plan Commission Approval. The property is zoned C2-PD which is a planned
development in Bridgepoint Commons.
Camille Hesen with Heritage Engineering 603 North Shore Drive Jeffersonville
Submitting a revised plat; previously approved but we updated an interior line between property lots 3 and 4.
Shifted 16 feet toward lot 4 and we added a utility easement at New Chapel and Gottbrath Parkway.
Mr. McCutcheon—is this standard for property this size to need to come back and make arrangements for
changing developments?
Ms. Hesen—originally there was a drive that was to be shared between two lots,the footprint for lot 4 was
finalized and client did not want to use the drive but provided shared access between the two lot.
Mr. Merkley—the code says Staff does not have the authority to make changes if it changes access points.

Board Comments: none
Ms. Gill made the motion to pass the revised final plat, seconded by Mr. Ellis, and motion passes 4-0-1
(Bottorff abstained).
PC-19-08 DEVELOPMENT PLAN APPROVAL
(tabled during docket approval)
ZO-19-03 PERMITTED USES AND STANDRDS UPDATE FOR NC ZONING DISTRICT
A text amendment for a Jeffersonville zoning ordinance was submitted for recommendation to the City
Council. The proposed amendment is to update the district intent permitted uses and development standards in the
neighborhood commercial zoning district.
Mr. Pruitt
• Downtown Commercial—Spring Street
• Neighborhood Commercial — residential buildings that are being converted into business uses;
professional services i.e. insurance office, legal offices, etc
• Cl—banks,fast food restaurants (small lot commercial)
• C2—big box retail, malls, shopping strips (large lot)
Focusing on NC—we have many properties zoned incorrectly is because it shows up in the intended uses for
the district; which is more restrictive than you need to be in a small format structure. There are homes on Tenth
Street that are currently zoned Cl (mismatched). Two areas we have studied which need changes due to City
infrastructure projects: Tenth Street revamp and Spring Street. We would like to get NC district to be more like R3
standards; making small changes to setbacks, permitted uses (more options).
Public Comment: David Nicklies, Nicklies 6060 Dutchmans Lane Louisville — I think it is great planning, it is
needed and it makes a lot of since the way it is drafted. Close public comment.
Board Comments: Ms. Gill -great presentation—please tell Chad.
Ms. Gill made the motion for a favorable recommend to City Council, seconded by Mr. Bottorff and motion
passes 5-0.
Reports from Director and Staff
Mr. Pruitt—our new position —Administrative Assistant staff member is on board, Cassie Nichols, a transfer
from the Police Department; thanks to the City Council and the Administration.

Board comments:
Mr. Avery — I want to recognize former employee, Jim Gillenwater, that built the last Animal Shelter and
saved the City a lot of money probably 30 years ago. He did a great job.

There being no further business to come before the Plan Commission the meeting was adjourned
at 6:36 pm.
