OF THE
JEFFERSONVILLE PLAN COMMISSION
January 29, 2019
Call to Order
Chairperson, Mike McCutcheon, called the meeting of the Jeffersonville Plan Commission to order at 6:04 pm in
the City Council Chambers,Jeffersonville City Hall, 500 Quartermaster Court,Jeffersonville, Indiana.
Roll Call
Members present were: Duard Avery, Kathy Bupp, Lisa Gill, Dustin White, Ron Ellis, Chris Bottorff and Mike
McCutcheon. Those members not present: none. Also present were Nathan Pruitt, Planning & Zoning Director, Les
Merkley, Planning & Zoning Attorney, Ashley Woolsey, Planning & Zoning Coordinator and Peggy Hardaway,
Secretary.
(Secretary's Note: All plat maps, photos, etc. presented before the Plan Commission on this date can be found in
the office of Planning and Development.)
Approval of Minutes
Motion made by Ms. Gill to approve the November 27, 2018 Minutes (no December meeting), seconded by Ms.
Bupp and motion passes 6-0.
Approval of Docket
Ms. Gill made a motion to amendment the docket to include election of officers and the election of the Board of
Zoning Appeals (BZA) appointment, seconded by Mr. Ellis and motion passes 6-0.
Ms. Gill made the motion to approve the amended docket, seconded by Mr. Ellis and motion passes 6-0.
Approval of Findings of Fact
None
Election of Officers
Ms. Gill made the motion to elect Mr. McCutcheon to continue as Chair, seconded by Mr. White and motion
passes 6-0.
Mr. Avery made the motion to elect Ms. Gill to Vice Chair, seconded by Mr. Ellis and motion passes 6-0.
Appointment to BZA
Ms. Rita Fleming was the Plan Commission appointment to the Board of Zoning Appeals. Due to time
commitments with her newly elected position as State Representative she needs to resign. Mr. Chris Bottorff is the
new Mayor appointment to Plan Commission.
Mr. Ellis made the motion to appoint Mr. Avery to the BZA, seconded by Ms. Gill and motion passes 6-0.

New Business
PC-19-01
The Greater Clark County Schools filed a development plan application for property at 601 and 605 East Court
Avenue. The property is zoned IS—institutional. The proposed development is an elementary school. The applicant

is requesting waivers regarding setbacks and landscaping. The applicant also filed a Development Standard Variance
application.
Greg Rasmussen with CEC Inc 530 East Ohio Street, Suite G, Indianapolis 46204 with Dr. Dykiel and Chad of
GCCS and Core Construction representation. Requesting:
• Minimum front setback+2.5 feet
• Minimum read setback 0 foot
• Minimum side setbacks 0 foot to+2.5 feet
• Minimum landscaping 1 deciduous tree, 0 evergreens, and 13 ornamental trees
• Buffer yard requirements—no buffer provided
• Total landscaping 47 trees provided
Board questions: Ms. Gill — Mr. Pruitt did they file an "in lieu" for the landscape because this is a significate
amount less in tree and landscaping—did they agree to that? Mr. Pruitt— no they did not. If you remember, there
was a remonstration a ballot petition basically to get the funding for this project and much like the City they are a
public institution so they are capped at $15 million with that bond. A large portion goes to that bond servicing so
there are only$11.5 million to build this building. They cannot go over budget. There are not a lot of extra funds for
landscaping, they have done what they can, and this site is urban and pervious already so there is not a whole lot of
room to put a lot in. So with those factors we did not feel it was appropriate to go through that process with them.
Ms. Gill—I think it was important for you to state that publicly because we do require that of our developers.
Public comment: support—none; against: none; close public comment.
Board Comments: Ms. Gill— I went over everything, their site plan, lighting plan, everything is in order. Mr.
McCutcheon —this is downtown where things are closer to the curb and you lose a little green space in some areas
and have to gain it in some others. But this is typical of some of the changes that we have moved for expansion
toward those areas.
Ms. Gill made the motion to pass PC-19-01 six waivers, second by Ms. Bupp and motion passes 6-0.
PC-19-02
Brandon Denton, Iron Street Partners LLC filed a rezoning application for a .25 acres parcel of property
located at 4721 New Chapel Road.This property will become part of the Bridgepointe Commons Planned
Development.The current zoning is C2 (Medium to Large Scale General Commercial) and the proposed zoning is C2-
PD (Planned Development—Commercial).

Public Comments: against—none, support—none
Board Comments: Mr. Bottorff indicated that he would need to abstain from voting due to a business
relationship.
Ms. Gill made the motion for a favorable recommendation to the City Council for the re-zoning, second by
Mr. White and motion passes 5-0-1 (Bottorff abstained).
ZO-19-01
Zoning Ordinance Amendment
The Jeffersonville City Council has recommended the following text amendment to the City of Jeffersonville
Zoning Ordinance (Jeffersonville Zoning Code 2000-OR-61). The update includes:
1. Adding standards for non-commercial livestock in Article 7 of the Jeffersonville Zoning Ordinance
Mr. Merkley - this was addressed by the City Council, this was in the Animal Ordinance, when the ordinance
was updated this was removed. Then City Council discussed putting it back and more research by the legal office
and Zoning office, and it was decided it was more of a land use issue. This comes to this Board with
recommendation from the City Council and the statue requires it goes to this Board before it goes back to City

Council for a vote. This establishes a standard code for non-commercial livestock standards, setting certain
definitions. No agriculture restrictions apply, but it does apply to any R1, R2 and R3 zone. Based on number of
animals you own, large or small, and square footage of owners lot, and will allow animals grandfathered in until they
die. Property owners can file a variance application for a fee for a special exception.
Discussion of the ordinance:
• Total number, size and replacement of animals
• Property lot size
• Hardship clause
• Grandfathered in until they die
• Roosters are band
• Fines and liens
Public Comments: against—none, support—none
Board discussion: several minutes again discussing the details of the text amendment.
Mr. White made the motion to table this until the April meeting, second by Mr. Avery and motion passes 5-1
(Gill).
PC-19-02
Zoning Ordinance Amendment
A text amendment was submitted for recommendation to the City Council. The update will amend Article
4.10 and Article 4.15. The changes would allow child care centers (day cares) in IS (Institutional Uses) and C2
(Medium to Large Scale General Commercial) zones as a use permitted by right.Through Certificates of Zoning
Compliance, Planning Staff has discovered there are several existing child care centers in these zones and believes
they were not included in the permitted uses as an oversight.
Ms. Woolsey—child care facilities by the State has a new requirement this year where they had to get there
use certified that is a certified use where they are located. So a lot have been coming to get their zoning
compliance, the ones that have been existing before we required that and through that process we realized there
are a lot of existing child care facilities and institutional uses and in the C2 districts. It was an oversight that they
were not originally included in those districts when the ordinance went into effect.
Public comment: support—none; against—none
Ms. Gill made the motion to pass text amendment, seconded by Ms. Bupp, and motion passes 6-0.

Mr. McCutcheon welcomed Mr. Bottorff to the Board.

There being no further business to come before the Plan Commission the meeting was adjourned
at 6:41 pm.
