HomeMy WebLinkAboutPC SEPTEMBER 25, 2018 MINUTES OF THE JEFFERSONVILLE PLAN COMMISSION September 25, 2018 Call to Order Chairperson, Mike McCutcheon called the meeting of the Jeffersonville Plan Commission to order at 6:01 pm in the City Council Chambers,Jeffersonville City Hall, 500 Quartermaster Court,Jeffersonville, Indiana. Roll Call Members present were: Duard Avery, Kathy Bupp, Rita Fleming, Lisa Gill, Ed Zastawny and Mike McCutcheon. Those members not present: Dustin White. Also present were Nathan Pruitt, Planning&Zoning Director, Les Merkley, Planning &Zoning Attorney, Ashley Woolsey, Planning &Zoning Coordinator and Peggy Hardaway, Secretary. (Secretary's Note: All plat maps, photos, etc. presented before the Plan Commission on this date can be found in the office of Planning and Development.) Approval of Minutes Motion made by Ms.Gill to approve the August 28,2018 Minutes,seconded by Dr. Fleming and motion passes 6-0. Approval of Docket Mr. Avery - request to approve the docket, but move item 8 (PC-18-67) and 9 (PC-18-68) to the top of new business; seconded by Ms. Gill and motion passes 6-0. Approval of Findings of Fact None Old Business PC-18-45 An application filed by the Sprigler Company located at 4219 Middle Road is zoned R1 low density residential to C2 medium to large scale general commercial. No one present to present the application which has been tabled twice and staff contacted with no response the Board continued with the process, Mr. McCutcheon open up for public comment; against — none; support — none. No calls or letters. A motion was made by Ms. Gill to send a no recommendation on to the City Council, seconded by Ms. Bupp, and motion passes 6-0. New Business PC-18-67 Hogan Real Estate filed a rezoning application for 927 Indiana Avenue. The property is zoned C2, medium to large scale general commercial. The proposed zoning is Cl, small to medium scale general commercial. Allen Applegate,428 Meigs Avenue, representing Hogan Real Estate - • Two docket items—one for base zone change from C2 to C1; the preliminary plat • 11 acres—mixed use, several verbal commitments from developers • presented pictures Board questions: none Letters—none Public comment: support— Mike Moore 803 East Court Avenue - • this project has been in the works for a long time, we are excited about it Page 1 of 5 Jeffersonville Plan Commission Meeting—September 25, 2018 • Will generate millions of dollars with shopping, office space, and hotel; amenities not offered in this area of Jeff • Sewer Board to develop%2 acre across the street as new welcoming entrance with landscaping • Asking the Board for a favorable approval Against: none; close public comment. Ms. Gill made the motion to pass on a favorable recommendation to send on to the City Council of a rezone for C2 to Cl, second by Ms. Bupp, and motion passes 6-0. PC-18-68 Hogan Real Estate filed a preliminary plat application for approximately 11.26 acres of property at 927 Indiana Avenue and will be subdivided into nine lots. • Note 4 lots designated as green space are part of the flood mitigation per subdivision ordinance This is the same information reviewed on PC-18-67;the Board continued at public comment. Questions: none Letters: none Public Comments: against—none, support- none Ms. Gill made the motion to pass on a preliminary plat, second by Mr. Zastawny, and motion passes 6-0. PC-18-60 Iron Street Partners filed a preliminary plat application for approximately 28.16 acres of property located at Gottbrath Parkway and Utica Sellersburg Road which will be subdivided into five lots for a PD, planned development in Bridgepointe Commons Section 2. Scott Hannah 603 N Shore Drive—representing Iron Street Partners Public comment: support—none; against—none Letters/calls: phone calls verifying what application was. Ms. Gill—made a motion to pass the preliminary plat approval; Dr. Fleming seconded the motion and motion passes 6-0. PC-18-61 BF Highway 62 filed a preliminary plat application for approximately 13.38 acres of property located at 4917 Highway 62,which will be subdivided into two lots.The property is zones C2PD—planned development. Josh Darby,Jacobi,Tombs, and Lanz on behalf of the applicant- • Subject property to be divided into two tracks—Track 1A and 1B • To complete Water Tower Road Public comments: support—none; against- none Letters/calls—none Ms. Gill made a motion to pass the application, seconded by Ms. Bupp and motion passes 6-0. PC-18-62 Sajid Chaudry for Cardinal Hospitality LLC filed a development plan application for property at 4403 Hamburg Pike. The property is zoned PD planned development. The applicant also filed a development standard variance application. Scott Moser with Accurus Engineering, 2780 Jefferson Center Way presenting • Holiday Inn Express, 4 story, behind first row of businesses along Veterans Parkway • Exceed PUD design - landscaping and parking; 96 parking spaces with detention pond • Lighting—zero bleed at property line • Signage plan — a 50 page document was submitted, Mr. Pruitt indicated that anything that is not incompliance they will have to come back to plan commission for review Public comment: support—none; against- none Page 2 of 5 Jeffersonville Plan Commission Meeting—September 25, 2018 Letters — Menards sent Cardinal Hospitality a letter that Cardinal Hospitality recognizes possible lighting, activity and noise issues from their sight. Ms. Gill made the motion to approve the development plan, seconded by Mr. Zastawny and motion passes 6-0. PC-18-63 Denton Floyd Real Estate Group filed a development plan application for property at 509 Spring Street. The proposed development is a DC Downtown Commercial property. Scott Hannah with Heritage Engineering— • Restore Masonic Hall building into office space • 0 feet side setback for new elevator structure • Will work with the city on the tree variance to be in compliance • Is working with Redevelopment for a shared parking area • Work will to include as much original structure (windows, etc) as possible Board comments: the Board is very happy that Denton Floyd took on this project Letters: none Public comments: Bob McAuliffe, 100 West Court Avenue—in support of this project,saving this historic building. Would like to discuss dumpster location, shared alley and parking with city and new owners. Mr. Hannah—they are happy to work with neighbors to review dumpster and parking issues. Board questions: none Ms. Gill made a motion to pass the development plan with approval of the adjoining property owner, seconded by Dr. Fleming, and motion passes 6-0. PC-18-64 Denton Floyd Real Estate Group filed a rezoning application for property at 4406 Helen Road. The current zoning is R1, single family residential to a M3, multi-family housing. Several waivers requested (see application). John Campbell with Heritage Engineering, 603 North Shore Drive, Suite 204,Jeffersonville— • Development and rezoning plan for 15—3 story buildings, 360 units starting at$1150/month with 600 parking spaces with several added amenities: court yards,volleyball court, pool,and lakes/detention • Lakeside Gardens at Helen Road and Herb Lewis; buffer areas with required plantings Public comments: Bob Miller, 4410 Herb Lewis Road — I will be looking right at those 360 apartments and over 600 vehicles. I was not sure if I was in support or opposed to this because no one contacted us. Herb Lewis Road is not a wide road; people slow down or come to a stop with meeting oncoming traffic. This will not work for 600 vehicles. 250 apartments were just built on this same road. I would think something better, not apartments are a good additional for this gateway to Jeffersonville. There is 512 homes being built behind us. Mr. Pruitt—we tend to improve roads after the problem has been identified. Engineering has seen this plan and did not flag anything. There are two exits with this plan. No known issues at this time. Board comments: Mr. Zastawny—covered parking? No Mr. McCutcheon—we know this is not in your control but you must have concerns for the residents and the width of the road? Mr. Campbell—we agree, and certainly the road needs to be widened as determined by the City to accommodate the traffic. Board continued discussing concerns over width of road. Letters—none Ms. Gill made a motion to approve rezoning from R1 to M3; seconded by Ms. Bupp, and motion passes 5-1 (Zastawny). Page 3 of 5 Jeffersonville Plan Commission Meeting—September 25, 2018 PC-18-65 Denton Floyd Real Estate Group filed a development plan application for property at 4406 Helen Road. Several variances requested (see application). John Campbell with Heritage Engineering, 603 North Shore Drive, Suite 204,Jeffersonville— Board Questions: Ms. Gill—will your signs meet compliance? Mr. Campbell—yes Public Comment: against—Mr. Robert Miller 4410 Herb Lewis Road, concerns about safety of road,the road is not wide enough for this much new traffic; support—none Board Questions: Dr. Fleming—concerns about parking going from requirements of 50% in garages down to zero, cheapens the project. Mr. Zastawny — concerns with variances of higher density, parking shortage, less amenities, and issues with narrow road — not against developments, but I don't feel we need to settle. Ms. Gill — concerned with the number of apartments and the narrow road. Mr. McCutcheon — I think if pressure is put on the road the road issue will have to be addressed; it has to happen. Letters: none Mr. Zastawny made the motion to deny the application (too many waivers),seconded by Dr. Fleming(lacking of public parking), and motion failed 3-3. Mr. Hannah, 603 North Shore Drive with applicant-would have like to request the Board to table the docket item so that we could have looked at the issues. Ms. Gill made the motion to table the docket item, second by Dr. Fleming and motion passes 5-1 (Zastawny). (note: docket item brought back to the table at end of meeting—see below) PC-18-66 1st Source Properties Development Group filed a development plan application for property at 2822 Sable Mill Road. The proposed development is a 10,500 square foot expansion of the existing facility on the property. Don Sandusky, 2822 Sable Mill Road — managing partner of 1st Source Properties LLC and President of the company who leases this property from the LLC Nathan Grines, 117 S Indiana Avenue Sellersburg— • would like to add a warehouse facility on the rear of the property. • Requesting a 21' setback on rear property line—we have a BZA approved 15-16. • Landscape plan—we will use tree preservation to meet guidelines Public Comments: support—none; against—none Letters, calls: none Ms. Gill made the motion to approved development plan that includes working out landscaping variance with Staff; seconded by Ms. Bupp; and motion carries 6-0. Before adjourning—Ms. Bupp questioned who follows up on approved developments? Mr. Pruitt— Building Commission does the building inspection; and Planning does landscaping inspection. Mr. Pruitt — we need to review the Board's questions of who is responsible for improving public roads and reference to other developments we need to have another internal conversation. I believe we need a special session to what our standards say, what would be tolerable. Mr. Hannah—we had the position to table tonight and wondering if we need to improvements Herb Lewis to City standards. We have an option situation that will run out soon; what if we will cover 50% - I don't know if I have an option to get back. Mr. Zastawny — I shared my concerns of the variances being asked — parking spaces and other concerns brought up with the road. I think it is totally within our means. Additional discussion continued. Ms. Bupp made a motion to bring the docket item PC-18-65 back to the table, because she believed that we did not give the applicant an opportunity to offer changes to variances. Seconded by Mr. Avery; motion failed 3-3 (support—Bupp, Avery, and McCutcheon). Page 4 of 5 Jeffersonville Plan Commission Meeting—September 25, 2018 Mr. Zastawny- I believe it is wrong to bring up an item because people who were here for this docket item left after our first vote, Ms. Gill agreed. Adjournment There being no further business to come before the Plan Commission, Ms. Gill made the motion to adjourn the meeting at 7:50 pm.
