HomeMy WebLinkAboutPC JUNE 26, 2018 MINUTES OF THE JEFFERSONVILLE PLAN COMMISSION June 26, 2018 Call to Order Chairperson, Mike McCutcheon called the meeting of the Jeffersonville Plan Commission was call to order at 6:03 pm in the Council Chambers, First Floor, Jeffersonville City Hall, 500 Quartermaster Court, Jeffersonville, Indiana. Roll Call Members present were: Duard Avery, Kathy Bupp, Rita Fleming, Ed Zastawny and Mike McCutcheon. Those members not present: Lisa Gill, and Dustin White. Also present were Nathan Pruitt, Planning & Zoning Director, Les Merkley, Planning & Zoning Attorney, Ashley Woolsey, Planning& Zoning Coordinator, and Peggy Hardaway, Secretary. (Secretary's Note: All plat maps, photos, etc. presented before the Plan Commission on this date can be found in the office of Planning and Development.) Approval of Minutes No minutes available to approve. Approval of Docket Mr. Zastawny made a motion to approve the docket as presented, seconded by Dr. Fleming, motion passed on a vote of 4-0. Approval of Findings of Fact None Old Business 1. PC-18-19 Debbie Smith for America Place filed a development plan application for a property at 150 Hilton Drive, the property is zone IR in the Indiana Army Ammunition Plant Redevelopment, the proposal development is in an office industry space. Spencer Heuke with Heritage Engineering—(Mr. White arrived) for this sight in River Ridge we are proposing 114,662 sq ft office building with cafeteria, outdoor seating, welcome atrium, and associated parking. 300 employees, 321 parking spaces (14 handicap accessible). Pictures presented of building, landscape, and they expecting future growth. Board questions: has this been approved by River Ridge — yes. Public comment: none. Board questions: Dr Fleming— how do you plan to heat/cool building? Not sure. Dr Fleming suggested consider solar heating because of massive roof. Note taken. Mr. White moved to pass application, seconded Mr. Zastawny, motion passed 5-0. 2. PC-18-23 Gilmore Construction has filed zoning application for 1417 Old Salem Road; current zoning is R1, residential. Requesting zone C2, commercial. Page 1 of 6 Jeffersonville Plan Commission Meeting—June 26, 2018 Alan Applegate with Applegate, Fifer, Pulliam - This is requested to allow the applicant to use the property uses that are more appropriate to land adjacent to Hwy 265 and the gateway road to the Town of Utica. Ruth and David Gilmore developed Indian Springs Subdivision, Stonebridge Apartments, Boulder Creek and Lighthouse Apartments—all which are in the city of Jeffersonville; 405 homes, 472 apartments, 49 lots to build on and 45 more acres to build residential homes. Maps presented. Property is across the highway from another gateway project. No current users for the property, they will let the market determine the uses. There are two streams on the property that would remain. David Blankenbeker, Blankenbeker & Son — reviewed area that will be completely undisturbed. Mr. Avery—is this the first exit off 265 from Kentucky? Yes Mr. Avery - I like this concept because it is the northern access to Utica yet you're leaving the resident far down Utica. Getting the buffer and usage right next to the interstate where the commercial usage, building I think it is a good fit on the sight. And this takes the pressure off I- 265 and 62. Dr Fleming—what is the relevance of the scenic byway designation? Mr. Applegate has not investigated that, other than to believe if it is a scenic byway would control highway perimeters, not sure the scenic controls outside that. Mr. Blankebeker answered that he understands that there is no billboards allowed, no truck stops on this property. Public comment: Michael Henderson, 2114 Utica-Sellersburg Road. Where will the heavy haul road be? The road will travel on the south portion of this property. Tom Vittito — River Ridge Planning & Development Authority. Scenic byway achieved yesterday. Make sure what is developed with property planning with interest of all parties. Mr. McCutcheon suggested that River Ridge develop a plan for developers to follow to suggestions the type of materials aesthetically pleasing. Close public comment. Mr. Applegate — the scenic byway is a Federal designation and governed by Federal/State laws and we would abide by the rules. Board Questions: none Mr. Pruitt: clarification of acres- 84. There is 450 commercial acres to fill up. Land uses with corporate boundary, mixed use for this property to provide additional housing. We have an inadequate amount of houses. We do believe this land adjacent to 265 is a good area for neighborhood development. Planning does not recommend the C2 zoning request because it is not in the best interest of the City's needs. PUD process would be more applicable. Mr. Merkley advised that this is a recommendation, that the City Council makes the final determination. Dr Fleming—does not think only commercial will draw the public to the area, but is housing is around the area they would support the commercial. Mr. White—Mr. Applegate are you considering this or is this off the table? Mr. Applegate— the C2 is on the table. A PUD requires a fully engineered drawings brought to the plan commission, then to the City Council which requires users and potential end users and then comes back to plan commission that we put the infrastructure in and it's in place before it is zoned a PUD. We do not have those users now and they would be required. Our client builds houses, there is 1073 lots in this area ($130,000 entry level homes). Owners are having difficulty selling the homes in the area. Page 2 of 6 Jeffersonville Plan Commission Meeting—June 26, 2018 Mr. Pruitt—the area is zoned commercial because of 62; it is primed and ready to get people to River Ridge; Old Salem Road is not that. Mr. Blankenbeker— if we are to cut this in half so that the main area around the interchange itself that you would want Rl single family homes in this area would this be a fair compromise to get approval today. Mr. Pruitt—maybe 1/3 would work, but that is a big decision for today. Mr. Blankenbeker—this market will develop this area. This is only a zoning request from R1 to C2. Mr. Merkley—Mr. Applegate what is adversity to do a PUD? Mr. Blankenbeker — we would be happy to do a PUD, but we will need commitment from commercial business to commit. Mr. Merkley—where is the proposed route for heavy haul road is? Mr. Blankenbeker—south property line Mr. Merkley— the C2 will provide a higher value for the purchase of your clients property for the heavy haul road? Mr. White—would you be willing to keep the heavy haul road area of your property R1? Mr. Pruitt—we need to follow our comprehensive plan as best we can achieve it. Mr. Avery—it is very difficult to building affordable housing. Mr. White made the recommendation that we pass this on the recommendation of "no recommendation"to the City Council. Seconded by Mr. Zastawny. Passes 5-0 New Business 3. PC-18-29 River Ridge Jeffersonville Properties LLC 350 Logistics Avenue the property is zoned IR, the proposed development is a bottling facility. John Uhl with CEI Engineering — Project Cincinnati - 400,069 sq ft building on 30 acres, anticipating around 65 new hires, potential of 35 additional. 241 parking stalls. River Ridge approved last May. Public comments: none. Letter/phone calls: none. Board questions: none Mr. Pruitt: several variances, typical of River Ridge. Mr. White made the motion to pass, seconded Mr. Zastawny,passed 5-0. 4. PC-18-30 Koetter Construction and Development for a property at 4725 New Middle Road the property is zoned Il (industrial). The proposed dev is for an expansion of vehicle storage. Josh Hillman with JTL—Knapheide is the owner of property(after body truck parts). Board Questions: Mr. Zastawny—what subdivision is this next to? Maple Hurst Mr. Pruitt—JTL was told their screening was not sufficient and they doubled their evergreens so that through winter you would not see their lot. Public comments: Mike Henderson, 2114 Utica Sellersburg Road—concern with noise, noise abatement? Patricia Henderson, 2114 Utica Sellersburg Road — how much land is coming toward Utica Sellersburg Road, and how much buffer is there going to be there so that I don't look out my front door and see all that. How tall the storage building going to be? How many trucks, and hours of operation? Mr. Avery—this is at the edge of the industrial usage and residential on the one side. Mr. Pruitt—yes Mr. Hillman — 25-30 foot range from the pavement. No changes to Utica Sellersburg Road. Higher Berm and trees should help to mitigate the noise. Sound should be the same — no new noises. Over the next couple of years volume may warrant a second shift (until 11 pm) Mr. Avery made the motion to approve, Mr. Zastawny seconded, passed 5-0. 5. PC-18-31 323 Ink Expansion, Comingore Properties filed an application for property at 2818 Sable Mill Road, property is zoned II, light industrial. The development is extension of a printing facility. Mr. Rose—we are requesting waiver of number of tree and will pay the fees if allowed. Mr. Pruitt — found out about the project late. We having been working with them and our concern is the R1 development behind there which needs good buffering which includes the landscape. They are willing to meet requirements suggested. Public Comment/questions: none Board Questions: none. Letter/calls: none. Mr. Zastawny made the motion to approve with the Tree in Lieu recommendation, seconded Mr. White. Passes 5-0 6. PC-18-32 Consolidated Grain & Barge Expansion 5130 Port Road, property zoned 12, industrial. The proposal is for an expansion of the existing receiving bulk storage facility. Bob Graverholt ASM Engineering Consultants — flat storage currently asphalt paved 120 x 300 building vinyl cladding with steel frame. Compatible with existing space. No space for landscaping. Lease by port of Indiana. Mr. Pruitt — has you secure a letter from Indiana American Water? We e-ail to ask because this is a well protection district because the ground water source is along the river and we have their approval. We have not received that yet. Counsel advises we can vote with contingency upon approval from Indiana American Water. Permit would be issue after receipt of approval. Public comment: none. Letters/calls: none. Mr. Zastawny made a motion to approve application with the stipulation— in lieu of landscaping for the Trees and contingent of approval letter from Indiana American Water. Seconded Mr. White. Passed: 5-0 7. PC-18-33 Tim Shea filed an application for rezoning HC (highway commercial) to DC (downtown commercial) 519 and 525 Michigan Avenue Katelyn Hines with YLEK New Albany. This request is actually at the request of the Department of Planning and Zoning, as an accommodations. One thing to bring up, there is possible a none conforming use in that Mr. Shea would still be able to operate a firework sales business within the property. We believe this fits all 5 elements of consideration. Public comment: none. Board Comments—none. Page 4 of 6 Jeffersonville Plan Commission Meeting—June 26, 2018 Mr. Pruitt—our staff has engaged with property owners in the Arts and Culture District. We asked property owners if they willing come along with an area wide rezoning. Mr. White—who owns the property at the small corner of Michigan and Court Avenue? Mr. Pruitt—City right a-way Mr. Zastawny moved to make a favorable recommendation for application. Ms. Buff Seconded. Motion passed 5-0. 8. PC-18-34 John Wolpert file a rezoning for 820 and 828 Spring Street. Current zoning is C1&C2 (commercial) to DC (downtown commercial). Mr. Pruitt — update — one of the properties we asked to change for the Arts and Culture District and he saw the potential to development property and they were excited. Public comment: none. Board Comments —none. Letters/calls: none. Board comments/questions: Mr. Avery—this was a body shop at one time so this is going to be a dramatic improvement. Mr. Zastawny made the motion of a favorable recommendation. Seconded by Mr. White. Motion carries. 9. PC-18-35 Pamela Johns filed an application for rezoning 2015 Allison Lane. Current zoning for property is R1 (residential). Proposed zoning is OC (Office Commercial). Pamela Johns—currently an Edward Jones office. Mr. Pruitt—Ms. Johns came in for an expansion permit and we realized her property is zoned residential. She is coming today to bring property up to correct zoning to proceed with expansion request. Public comments: none. Mr. Zastawny made the motion for a favorable recommendation. Ms. Bupp seconded. Motion carries 5-0. 10. PC-18-36 Request to table Jefferson Ridge PUD; 3604-3818 East Tenth Street. Mr. Zastawny made the motion to table, seconded by Ms. Bupp. Motion carries. 11. PC-18-37 and 12. PC-18-38 5111 Hwy 62 LLC & BF Highway 62 LLC filed an application to rezone Bridgepooint Commons — Gateway Center PD; 5111 Highway 62 (multiple parcels). Currently zoned C2 (medium to large scale general commercial) to PD-C2 (planned development) Camille Hesen—Heritage Engineering, Jeffersonville. We are planning to rezone and would like to include them with our PD across the street. Mr. Pruitt—is it correct that you are transferring all the development standard in Gothbreath across and just mirroring it. Expanding development. Public comment: none. Board comment/questions: none. Letters/calls: none. Mr. White moved that we pass PC-18-37 on to Council with favorable recommend, second with Ms. Bupp. Motion passed 5-0. PC-18-38 represented by Josh Hillman, JTL. Mr. White moved to approve application. Second Mr. Zastawny. Motion approved 5-0. 13. PC-18-39 John McClain for Aldi's filed a development application property at 3131 East 1 Tenth Street, zoned C2 (commercial). The proposed application is for a sign waiver for the grocery store. John McClain with Aldi's. Mr. Pruitt - our sign code require that a face replacement trigger our current standards. Our current standard high feet is 8 feet. They want to re-face the sign. Requesting 20 feet tall. Mr. McCutcheon - Dollars Store on New Albany/Jeff Pike has the same sign size with concert bottom. Public comment: none. Letters/calls: none. Mr. White- emblems different? There is a different one in Germany. Just updating to new logo. Mr. Pruitt - the sign will go in the old sign area, but because it is a re-face it must meet the current standard. Change face only with energy efficiency lighting. Mr. White- moved we approved application. Ms. Bupp seconded. Motion passed 3-1 with Mr. Zastawny opposing. Staff Reports: Mr. Pruitt introduced new hire, Ashley Woolsley from Clarksville and is familiar in this area and Peggy Hardaway, secretary to take minutes. Mr. Zastawny-Kort Rehab has a banner up-what is going on there and will this give us the chance to do something about that lighted sign. Mr. Pruitt - our office has been in communication with them and they are not happy because they would like to re-face sign but they have to remove LED to meet current standards. We are still negotiating.
