HomeMy WebLinkAboutSEPTEMBER 27,2016 MINUTES OF THE JEFFERSONVILLE PLAN COMMISSION September 27, 2016 • Call to Order A meeting of the Jeffersonville Plan Commission was held on September 27, 2016 at 6:05 p.m. in the Council Chambers, First Floor, Jeffersonville City Hall, 500 Quartermaster Court, Jeffersonville, Indiana. Vice Chairperson Lisa Gill called the meeting to order. • Roll Call The roll was called and those members present were: Duard Avery, Kathy Bupp, Rita Fleming, Lisa Gill, and Mike McCutcheon. Those members not present: Scott Hawkins and Ed Zastawny. Also present were Linda Mills, Secretary, Nathan Pruitt, Planning&Zoning Director, Les Merkley, Planning& Zoning Attorney. (SECRETARY'S NOTE: ALL PLAT MAPS, PHOTOS, ETC. PRESENTED BEFORE THE PLAN COMMISSION ON THIS DATE CAN BE FOUND IN THE OFFICE OF PLANNING AND DEVELOPMENT.) y • Approval of Minutes The minutes of the June 28, 2016 meeting were approved as written on a motion made by Rita Fleming and seconded by Kathy Bupp. Motion passed on a vote of 4-0. The minutes of the August 30, 2016 meeting were approved as written on a motion made by Rita Fleming and seconded by Kathy Bupp. Motion passed on a vote of 4-0. • New Business 1) PC-16-59 The next item to come before the Commission is an application filed by Brandon Denton requesting a rezoning for multiple properties along New Chapel Road and Utica Sellersburg Road. The properties are currently R1 (Low Density Residential). R3 (Old City Residential) and IS (Institutional). The proposed zoning is C2 (Medium to Large Scale General Commercial). Mike McCutcheon came into the meeting. Lisa Gill stated the following: • The applicant is requesting that this application to be tabled; • It will come before the Commission next month; and • There is a hand out on the table for any person who is here for this application. Jeffersonville Plan Commission Meeting— September 27, 2016 Page I of 7 Les Merkley stated the following: • There will be neighborhood meeting regarding this application next Tuesday at 7:00 p.m. at the Crystal Springs clubhouse; • This meeting was requested by the Mayor so that the developer and address any questions or concerns the neighbors may have; and • The Planning& Zoning signs that were posted in the area was located on the wrong parcels which was a mistake from the City and the City does apologize for that. Therefore, upon a motion made by Rita Fleming and seconded by Kathy Bupp to table this application until the next schedule meeting. Motion passed on a vote of 5-0. 2) PC-16-60 The next item to come before the Commission is an application filed by David Sanders requesting development plan approval for property located at 1317 E. 10th Street. The proposed development is a 1,760 square-foot gas station and convenience store. The development also requires Board of Zoning Appeals approval of multiple variances. David Sanders appeared before the Commission and stated the following: • We are looking to redevelop the corner of E. 10th and Main Streets; • With the 10th Street widen project there will be additional work that would eliminate two of the drives and reduce the access down to two; • The grass area and tree yard in front of the property will be decrease; • I spoke with Nathan Pruitt and Andy Crouch and the intent is that the City will do some tree scape in this area as part of the 10th Street widen project; • We are proposing some screening of the parking area; • There is an existing sign on site that meets all the sign standards; • This is an existing gas station but the fagade will changed and the look of the building will change; and • Ice storage and propane tanks will be screened from 10th and Main Streets. Nathan Pruitt stated the following: • Parking lot lighting there is nothing above 20' on this site; • We did review the foot candles and it meets the standards; • The 10th Street project will be doing some landscaping and based on the factors not having an adequate tree line they are just not able to do the landscaping; and • One area that I would like to point out is that there is some opportunity for f landscaping along 10" Street. t David Sanders stated that they will add landscaping to that area. Page 2 of 7 Jeffersonville Plan Commission Meeting— September 27, 2016 Therefore, upon a motion made by Rita Fleming and seconded by Kathy Bupp to approve the development plan with the requested waivers and the additional landscaping to the area facing 10th Street. Motion passed on a vote 5-0. 3) PC-16-61 The next item to come before the Commission is an application filed by David Blankenbeker requesting approval of a preliminary plat for property located off of Charlestown Pike near the intersection with Holmans Lane in the Buttonwood Subdivision. The addition is for 30 lots for phase 8 of the subdivision. Duard Avery stated that his has an interest in a structure that he is building in Buttonwood so he will abstain from the vote. Keith Mull. Attorney appeared before the Commission and stated the following: • This request is for Buttonwood Unit 8; • 11.02 acres of property located off of Charlestown Pike adjacent to Courtyards of Buttonwood; • Buttonwood has the reputation of being one of the nicest development in Jeffersonville; • This will have 30 lots and comparable to units 1-7 sections; • Restrictions will be similar to the other sections; • Will comply with R1 zoning classifications; • This will be developed in two sections; • It does connect into existing Buttonwood sections; • Badger Run has a separate in and out; • Lot A is an existing detention basin that the developer maintained for five years; • In the final plat we are proposing that this be dedicated to the City's since the five years has already past; • There is a space just outside this Unit of very large oak trees, this will be a tree preservation area; and • Sidewalks on both sides of the street, the walkability will be improved. David Blankenbeker appeared before the Commission and stated the following: • The plan does not specifically address street lights but will comply with City's regulations. Nathan Pruitt stated the following: • We do have a landscape requirement for subdivisions and very excited to see a 5' tree line between the curb and the sidewalk; t _ • Our requirement is three deciduous trees per 10,000 square foot lot; and Page 3 of 7 Jeffersonville Plan Commission Meeting— September 27, 2016 i • Two trees in tree line for each lot and one additional on lot. David Blankenbeker stated that any requirements for trees will be followed. Danielle Carrillo, 3002 Walnut Cove Court appeared before the Commission and stated the following: • It looks like there will be eight houses behind my street and it seems that the lots are a lot smaller than the previous units; • Will the pricing be about the same is it going to be the same style of housing; • Excited about the sidewalks; and • Will the neighborhood restrictions be the same as the rest of the neighborhood, would like to have some standards. Keith Mull stated that the restrictions will be similar as the previous units. Therefore, Rita Fleming made a motion seconded by Mike McCutcheon to approve the preliminary plat as presented. Motion passed on a vote of 4-0. 4) ZO-16-03 The next item to come before the Commission is an amendment to the Jeffersonville Zoning Ordinance (200-OR-61) for recommendation to the City Council. The proposed amendment would amend process in Article 12: o Add Section 12.5 requiring an Application for Certificate of Zoning Compliance(CZC) for all new businesses in the City; o Required $50 fee; and o Fine of$250 in addition to the fee if not sought and business opens without CZC. Nathan Pruitt stated the following: • This is a potential change to the zoning requirements; • This is a requirement within our process; • We have issues with businesses not maintaining contact with our department and purchasing properties and then finding out that the use is not allowed; • We are trying to get ahead of that and what we are recommending is that we adopt Article 12 Certificate Zoning Compliance; • This is a one page form and the application fee is $50; • This would be required before occupancy or use and is signed by the current planner; • This just gives us another tool for the community so that they know they need to be communicating with the Planning Department; and Li • We would also add new language into the Zoning Code that they may be a potential fine if they do not comply, the fine would be $250. Page 4 of 7 Jeffersonville Plan Commission Meeting—September 27, 2016 Lisa Gill asked if this is passes how would the fines be implemented. Nathan Pruitt stated this would be handed through his office and stated the following: • The next portion is in regards to our fee schedule; • There are currently two rates for development fees and one is $275 and the other is $175; • These our fees that have not been updated since 2001; and • We did some market research and look at what other communities are charging and have submitted the proposed fee changes. Rita Fleming stated that it seems reasonable and in line with other communities. Nathan Pruitt stated that his Department is not revenue positive we operate under the General Fund and provide a great service to the community in reviewing developments and as time move forward our staffing cost has increase and this is one way to stay in line with our administrative cost. Christopher Fox stated the following: • I am a realtor in this community; • I work with the Board of Zoning Appeals; • It has come to our attention recently that vacant and abandoned properties have become an issue; • The Banks are not following the guidelines; • It is a concern when some of us pay the $50 registration fee and then some of them don't; • What are we going to do to get back in line, how are we going enforce that; • I don't think everybody knows this; and • I think we need some kind of public letter sent to the Realtor Association letting them know if you are going to represent an abandoned property or bank owned property that they have to follow the rules in Jeffersonville. Nathan Pruitt stated that this is a great ideal and I don't think it is out of the question to ask the City to remind the realtors regulations that they need to follow. Therefore, upon a motion made by Rita Fleming and seconded by Kathy Bupp to send a favorable recommendation to City Council to adopt the changes in Article 12 requiring an application for Certificate of Zoning Compliance for all new businesses and to include the proposed schedule of fees. Motion passed on a vote of 5-0. • Reports from Officers, Committees and Staff Nathan Pruitt stated the following: a) Development Update Report Page 5 of 7 Jeffersonville Plan Commission Meeting— September 27, 2016 • This is an development update; • I pull the number of how many acres we are currently developing into commercial; • There are eight major commercial developments happening right now, which translate into 400 acres of build; • We are also having 12%job growth every five years; • We have a lot of things happening on 10th Street near the 265 interchanges; • We have done 24 new developments this year which includes 2.4 million square feet of development; and • We have done almost 3,000 new parking spaces this year and installed about 2,500 of new trees. b) Downtown Residential Overlay District(DRO) Nathan Pruitt stated the following: • We have a lot of things happening downtown; • Working on a new overlay district for the downtown area this would specifically address residential; • The purpose of the district is removed some of those barriers in residential development; • Some of this in this proposal is 0' setbacks, residential that does not require ground floor retail; • We are going to remove some of those details so we attract the development that we want; • This is outlined in our new Comprehensive Plan that we adopted in 2015; • Promote some good plan growth; • We want to support revitalization of lots that are brownfield and vacant for a long time; • The Ohio Bridges project is wrapping up and will require more demand for downtown living; • We have a population here in Jeffersonville of 46,000; • We have about 20,000 units of housing; • River Ridge is expanding and we are about 15%built out; • Total workforce today is 24,000; • What we are asking is where do we put all these housing units; • New jobs means housing demands; • Can we build, do we have enough land to build new homes; • We have looked at four scenarios; • Scenario number one is at current development levels, we use the existing R1 standards; • Under current development patterns we are 297 acres short; i • We will hit full build out before 2022 and be under what we need as far as housing; Page 6 of 7 Jeffersonville Plan Commission Meeting—September 27, 2016 • If we do a different scenario and start approving different developments as we did on Peach Blossom, we are only 169 acres short; • The two last housing scenarios gets better and we actually have land left over for future development; • Increase general vibrancy of Downtown; • We want to be good neighbors and do infill well; • Helps us with more residents and to stay competitive with other communities; • More activity on the streets; • This will help increase local support of Arts and Cultural, increase local market for restaurants and retail; • Increase land values and tax revenues; • More eyes on the street tends to improve safety; and • Provides mix housing for growing segments of population that are not as interested in single-family homes on large lots, this includes young professionals, empty-nesters and seniors. • Adjournment There being no further business to come before the Plan Commission the meeting was adjourned at 7:09 p.m. Lisa 6ill, Vice Chairperson Submitte n Mills, Secret y Page 7 of 7 Jeffersonville Plan Commission Meeting—September 27, 2016
