1. Call to Order
A meeting of the Jeffersonville Plan Commission was held on June 28, 2016 at 6:07
p.m. in the Council Chambers, First Floor, Jeffersonville City Hall, 500
Quartermaster Court, Jeffersonville, Indiana. Vice Chairperson Lisa Gill called the
meeting to order.
2. Roll Call
The roll was called and those members present were: Duard Avery, Kathy Bupp, Rita
Fleming, Lisa Gill, and Ed Zastawny. Those members not present: Scott Hawkins
and Brent Roberts. Also present were Linda Mills, Secretary, Nathan Pruitt, Planning
& Zoning Director, Les Merkley, Planning & Zoning Attorney.

3. Approval of Minutes
A motion made by Ed Zastawny and seconded by Kathy Bupp to table the minutes
until the next schedule meeting. Motion passed on a vote of 5-0.
4. New Business
1) PC-16-45
The next item to come before the Commission is an application filed by Charles
Poindexter Jr. requesting approval of a minor plat for property located at 509 Hopkins
Lane. The plat creates two lots. The lots meet the district standards except lot 71
requires a waiver of 8.5 feet from the minimum lot width standard.
Charles Poindexter appeared before the Commission and stated the following:
• We have property on Hopkins Lane and we had it surveyed;
• We are wanting to build a house on the lot but it is only 61.5 feet wide; and
• We are requesting an 8 '/2 feet waiver for the minimum lot width standard.
Therefore, upon a motion made by Rita Fleming and seconded by Ed Zastawny to
approve the final plat with the requested waiver of 8 1/2 feet. Motion passed on a vote
of 5-0.

The next item to come before the Commission is an application filed by Brandon
Denton requesting development plan approval for property located on Peach Blossom
Drive. The proposed development is an apartment complex. The applicant is
requesting a waiver from the Amenity Standards and Off-Street Parking
Brandon Denton appeared before the Commission and stated the following:
• Requesting approval for a multi-family development;
• The land is currently vacant and is zoned M3;
• The development is 264 units class A with one, two and three bedroom
apartments;
• We have several amenities to make it a class A facility;
• Proposing a pool, sand volleyball courts, dog run, walking trails and a lot of
landscaping;
• The fagade will be Hardy Plank with 80% brick;
• Using very nice exterior lighting;
• This fagade is consider more of a high end than an all brick facility this is more
of a three dimensional look;
• Construction is expected to take place in Spring of 2017; and
• Will be using trash compactors instead of dumpsters.
Scott Hannah with Heritage Engineering appeared before the Commission and stated
the following:
• Requesting a variance on parking 415 spaces is required by ordinance and we
are requesting 245 spaces;
• This will leave more open spaces; and
• Code requires 50% of spaces to be included as a garage and we are not
proposing a garage.
Nathan Pruitt stated the following:
• Requesting amenity standards waiver as per number of units you are required
to have a certain number of amenities;
• They have provided all of those except for the large park but the Plan
Commission shall have the authority to except clearly equivalent or greater
equivalent amenity in lieu of what is required;
• At their scale of development they are not required to provide a pool but they
are provided a pool, which could substitute for the large park; and
• In addition to that they are provided a dog park and a playground equipment
area.
Ed Zastawny stated the following:

• I was part of the process when we included garage space in the code and what
we was thinking of if we have some up-scale apartments that there was some
options should you want your car protected; and
• It seems reasonable to have some enclosed parking if this is an up-scale
apartment.
Scott Hannah stated that we are providing sidewalks along Peach Blossom Drive and
will connect to the existing sidewalks on both sides of the property. We will have
sidewalks internal on the site.
Rita Fleming stated that she likes the less parking concept.
Lisa Gill stated that she liked the lighting package but did not see any signage.
Scott Hannah stated that they will be proposing a monument sign that will meet the
existing code.
Brandon Denton stated that this project does not have garages but they did think about
carports but it would add a lot of expanse to the project and add more pavement.
Nathan Pruitt stated the following:
• On the lighting plan they have some pedestrian scale lighting on the side of the
building;
• I ask for additional percentage of brick from the original plan and they
provided that;
• Overall they have been very good to work with;
• They are proposing three fences, one on the north side of Peach Blossom
Drive, it is a requirement per our code;
• I feel that this is an overbearing requirement and that landscaping would be
sufficient;
• You could consider granting them that fence waiver to that standard;
• There is also a 6' privacy fence near the empty space and you could also
consider to waive that fence as well; and
• On the south portion of the property by the homes that come off 10th Street
they are not required because it is zoned C2 to put a buffer yard with a fence
but since the existing use is residential they have voluntarily put in a 6' privacy
fence in addition to the green space.
Scott Hannah stated that he would like to add that waiver if possible with the fences.
Felix Santiago, 2823 Hoskins Drive appeared before the Commission and stated the
following:
• I have lived at 2823 Hoskins Drive for 30 years;
` • Putting apartments at this location will not help me out;

• I'm not pro for this development but I'm not against it either;
• I have concerns regarding lighting, my house is right behind the apartments;
• Concerned about drainage, water comes down and ponds on my property and
my neighbor property;
• I like the fence but the buildings are three-stories high and the 6' fence will not
do a lot but at least it will keep people from walking across my property;
• A little concerned about the trash compactor, what will be the hours of
operation, will it be at night or early morning, concerned about the noise; and
• There are tower for power lines going across the property, concerned about the
radiation. A lot of people believe that it can contribute to illnesses in children.
Nathan Pruitt stated that they are outside of the utility easement and are permitted to
build at this location.
Brandon Denton stated the following:
• The Drainage Board will have to approve the plan but feels confident that
there will not be any negative effect to neighboring properties; and
• The trash compactor was the other issue he mentioned not sure on how much
noise it would create.
Scott Hannah stated the following:
• The noise of the trash compactor would be a lot less than a truck unloading the
dumpster;
• 0' foot candles on property line so no light should bleed onto the neighboring
properties;
• We are providing a fence plus landscaping; and
• The landscaping is going to go end at 6' and we will be 30' off the property
line.
Brandon Denton stated that there will be three floor plans, one bedroom will be about
850 square feet, two bedrooms about 1,100 square feet, three bedrooms about 1,400
square feet. The rent will range from $875 to $1,650 a month.
Therefore, upon a motion made by Duard Avery and seconded by Rita Fleming to
approve the Development Plan with the waivers for fence and amenity substitution
contingent upon Board of Zoning Appeals approval. Motion passed on a vote of 4-1
with Ed Zastawny voting against the motion.
3) PC-16-47
The next item to come before the Commission is an application filed by 1St Source
Properties requesting variances from the development standards for property located at
2822 Sable Mill Road. The applicant is requesting variances from the development

standards from the following standards for an RV storage facility: Landscaping and
setback standards.
Eric Rider appeared before the Commission and stated the following:
• Proposing to build storage units for RV's and large boats;
• These facilities will be enclosed structures; and
• They will be closer than the 30' required; and
• The units will be 10' from the property line.
Nathan Pruitt stated that they did not submit a landscape plan so there will have to be a
waiver on landscaping, the minimum rear yard setback proposed at 21' that would be a
variance of 9'. A minimum side yard setback they are proposing 10' the requirement
is 30' a waiver of 20'.
Don Sandusky appeared before the Commission and stated that he was waiting for this
variance to be approved before he received a landscaping design.
Nathan Pruitt stated that landscaping is a requirement for a new build.
Don Sandusky stated that the only answer is ignorance; I thought we had to get the
variance first before we proceeded with the landscaping.
Therefore, upon a motion made by Rita Fleming and seconded by Ed Zastawny to
table this application due to lack of landscaping. Motion passed on a vote of 5-0.
5. Reports from Officers, Committees and Staff
None.
6. Adjournment
There being no further business to come before the Plan Commission the meeting was
adjourned at 6:46 p.m.
