HomeMy WebLinkAboutJULY 30TH 2013 MINUTES OF THE JEFFE.RSONVILLE PLAN COMMISSION July 30. 2013 1) Call to Order A meeting of the Jeffersonville Plan Commission was held on July 30, 2013 at 6:00 p.m. in the Council Chambers, First Floor, Jeffersonville City Hall, 500 Quartermaster Court, Jeffersonville, Indiana. Chairperson Josh Rodriquez called the meeting to order. 2) Roll Call The roll was called and those members present were: Kathy Bupp, Ed Zastawny, Rita Fleming, Connie Sellers, Brent Roberts, Josh Rodriquez, and Lisa Gill. Those members not present: None. Also present were Linda Mills, Secretary, Shane Corbin, Planning & Zoning Director, Dan Matson, Planning & Zoning Coordinator and Les Merkley, Planning & Zoning Attorney. (SECRETARY'S NOTE: ALL PLAT MAPS, PHOTOS., ETC. PRESENTED BEFORE THE PLAN COMMISSION ON THIS DATE CAN BE FOUND IN THE OFFICE OF PLANNING AND DEVELOPMENT.) 3) Approval of Minutes The minutes of the June 25, 2013 meeting and the July 9, 2013 special meeting were approved as written on a motion made by Brent Roberts and seconded by Lisa Gill. 4) New Business a) PC The next item to come before the Commission was an application filed by Eddie Sprigler for a rezoning of a vacant property located on Coopers Lane. The property is known as Lot "A" of the Georgia Crossing, Section Two, Subdivision, and it contains 5.2 acres and two parcels (10-21-03-500-886.000-009 & 10-21-03-500-887.000:009). The property is currently zoned M1 (Low Density Multifamily Residential) and the proposed zoning is Cl (Small to Medium Scale General Commercial). Alan Applegate on behalf of Sprigler Concrete appeared before the Commission and stated the following: • Seeking to re-zone 5.2 acres from M1 to Cl currently has a verbal option to purchase the property; • A detention basin is situated on this lot; • The lot has about 500 feet of frontage on Coopers Lane; Page 1 of 10 Jeffersonville Plan Commission Meeting —July 30, 2013 • The detention basin is engineered to accommodate the proposed use of the subject property; • The applicant is doing business in Clarksville but would like to re-locate to Jeffersonville; • The company currently has approximately 25 employees representing a payroll in access of $600,000; • This proposed site if approved would enable him to hire an additional 10 employees, only three of the employees would actual work at this site; • The remaining employees would be at the subject property in the morning (between 7:00 a.m. and 7:30 a.m. and in the afternoon between 3:30 p.m. and 6:00 p.m.); 1 Would like to construct an 8.000 square foot building with parking; • There will be a contractor's office, which requires a Special Exception from the Board of Zoning Appeals; • There will be approximately 48 parking spaces; • Development plan is not in place at this time; • Applicant would construct a 5 foot earth berm along the entire property line adjacent to Georgia Crossing, Section 2. This berm would be topped with two (2) staggered rows of evergreen trees six (6) feet on center; and • The existing zoning classification would allow the construction of multifamily residential. More than 900 feet of this 5.5 are parcel is immediately adjacent to 1-265 the classification is not the most desirable classification for this property. Shane Corbin stated to the Commission that he received a couple of phone calls inquiring about the project and one phone call in opposition. Bob Bitner appeared before the Commission and stated the following: • Concerned that this type of operation will have negative value to his property; and • Dispute the statement stating that the property would not be the most desirable for residential because of 1-265, there is a new development next to 1-265 and is doing fine. Cheri Davis, 3409 Coopers Lane appeared before the Commission stated the following: • Does not object with the office building but has safety concerns with the concrete business pulling out onto Coopers Lane; • Would the elevation in the detention pond be changed, must drainage goes onto the front of my property; • How many trucks will be washed there in the evening and where would it drain; • How will the lighting be installed and if there would be any billboards; and • If the company decided to sell in the future how would that impact the neighbors? Vickie Uhl, 3906 Coopers Lane appeared before the Commission and stated the following: Page 2 of 10 Jeffersonville Plan Commission Meeting —July 30, 2013 • Concerned about the zoning change and asking for a variance to be closer to the road then what is allowed; and • Concerned about washing out the concrete trucks. Jesse Bailew, 4816 Hamburg Pike appeared before the Commission and stated the following: • Developer of Hidden Lakes Subdivision and was not allowed to place a building that close to the road; and • Believes this would be a bad decision to spot zone this parcel. Alan Applegate stated the following: 9 The patio home development along 1-265 most of the units are leased, they have not been sold; • Asking a variance that would allow us to construct a parking lot 5 feet from the McClintock Cemetery. If the variance is not granted the proposed project could still work; • Would not be changing the detention basin but the parking would be close to the basin; • Safety concerns, with this development there would be no room to hide for vandalism; and • There would be no concrete trucks; this would be a contractor's office. Therefore, upon a motion made by Brent Roberts and seconded by Connie Sellers, the Commission voted 7-0 to send a non-favorable recommendation to the City Council for the rezoning of property located on Coopers Lane, Lot "A" of the Georgia Crossing, Section Two, Subdivision from M1 (Low Density Multifamily Residential) to Cl (Small to Medium Scale General Commercial). b) PC-13-24 The next item to come before the Commission is an application filed by Kevin. Guernsey for rezoning the property located at 2004 Utica Pike. This property contains 0.886 acres and is identified by the parcel number 10-19-00-301-333.000-009. The property is currently zoned R1 (Low Density Residential) and the requested zoning is M1 (Low Density Multifamily Residential). The applicant is proposing to use the existing building as a duplex and no construction is planned. Kevin Guernsey appeared before the Commission and stated the following: • The property has approximately a 6,000 square foot structure on the parcel; • No changes will be done on the outside of the property; • The other property uses adjoining mine is a marina and a couple other R1 zoning parcels; • This structure would be divided into two units, a high end rental to adults; and Page 3 of 10 Jeffersonville Plan Commission Meeting —July 30, 2013 • Will be requesting a permit from the City to add a kitchen to one of the units but no intention to build anything. Shane Corbin stated that he received one petition from the neighbors concerned about allowing a Ml, would be a start of much more than duplexes and may involve into a apartment complex. Kevin Guernsey stated that the rent would be pretty high, with all utilities it would be about $3,000 a month. There is also a large area in the back of the property for parking. Steve Ogden, 2010 Utica Pike appeared before the Conunission and stated the following: • Opposed the zoning change to multifamily; • Concerned about the amount of traffic; and • Concerned that this might become more. Dan Donahue, 2008 Utica Pike appeared before the Commission and stated the following: • Have no objection to making the home a duplex; and • Concerned it would be made into a 4 unit, if you grant the zoning change it would open the door for more multifamily. Kevin Guernsey stated that if he would make it more than two units, I would have to put in a sprinkler throughout the building, which would be too costly. Doris Miller Hicks, 2.005 Utica Pike appeared before the Commission and stated the following: • Concerned about what would happen with the pool and easement to the river; and • Concerned it would be turned into a bed and breakfast and would damage the property value. Rita Fleming stated that she is going to abstain from voting because she lives on Utica Pike. Therefore, upon a motion made by Brent Roberts and seconded by Ed Zastawny, the Commission voted 6-0 to send a favorable recommendation to the City Council for the rezoning of property located at 2004 Utica Pike from R1 (Low Density Residential) to M1 (Low Density Multifamily Residential). c) PC-13-25 The next item to come before the Commission is an application filed by Jeffie Maag for rezoning property located at 1410 East Eighth Street. The property is currently zoned R3 (Old City Residential) and the proposed zoning is NC (Neighborhood Commercial). A Page 4 of 10 Jeffersonville Plan Commission Meeting —July 30, 2013 home occupation was converted to a business and this is not permitted in the R3 zoning district. Jeffie Maag appeared before the Commission and stated the following: • In October of 2007 moved into the home and at that time had a home based business; • The business is a home health for children and young adults with medical complex needs; • From the home we organize the care that the client would receive by our nurses in the field; • It is pretty unusual that people come to the office unless we specifically invite them for an interview; • The exception would have been when the nurses came every Friday to pick up their paycheck, however we have now have them on direct deposit; • We have about 42 nurses on staff, our payroll runs about $104,000 monthly; • Have seven people that work in the office, out of the seven, three of us walk to work, two carpool and two drive; • Have adequate parking behind the house for at least seven vehicles; and • We move next door and gravel a large area for any overflow parking should we ever need it. Shane Corbin stated that he received one letter in opposition and initially we received a complaint regarding this business. Robert Patterson, 645 Main Street appeared before the Commission and stated the following: • The subject property is directly behind my property and had some of the people parking on my lot; • Have found garbage and dirty diapers from the people going into her property; • Been in the neighborhood for fifty-seven years and would like to keep it residential as much as possible. Keith Daunhauer, 647 Main Street appeared before the Commission and stated the following: • Have a lot of elderly and disable people in the neighborhood and it is a very small alley way, the applicant does not have a driveway, they park cars side by side seven days a week; • Carrier will make deliveries at all times during the day and have seen them there at midnight; and • Not a safe place at all, there are unsavory people coming to the property, there is also a wheel chair ramp located at the back of the property. Jeffie Maag stated the following to the Commission: Page 5 of 10 Jeffersonville Plan Commission Meeting —July 30, 2013 • When 1 was still living there my friend had fallen and broken her arm, we had a wheel chair ramp 'installed so that she could visit; • We do not have people corning to the property for treatment; • Have a client that lives four blocks away that may stop by, but we do not provide any care; and. • Have eliminated staff picking up their paychecks, they may come by on Friday or Saturday to drop off notes. Therefore, upon a motion made by Ed. Zastawny and seconded by Lisa Grill, the Commission voted 7 -0 to send a non - favorable recommendation to the City Council for the rezoning of property located at 1410 East Eighth Street from R3 (Old City Residential) to NC (Neighborhood. Commercial). d) PC -13 -26 The next item to come before the Commission is an application filed by Brian Donaghy for development plan review for property located at 4016 Utica Sellersburg Road. The proposed development is a recycling center that includes a 4,800 square foot building and a storage yard. The applicant is requesting a waiver from the pedestrian access standard. The property contains 7.98 acres and is zoned 11 (Business Park/Light Industrial). Jack Vissing representing Brian Donaghy appeared before the Commission and stated the following: • This property became industrial in 1954; • It's been an auto salvage yard, in 2008 ISA carne before this Board and made a proposal to put in a recycling center at this same site and to clean it up; • Will not remove any trees along the sides of the property; • There will be a new front facade and a new tree line, and • Does not show sidewalks on the plan but will be willing to install them. Brian Donaghy appeared before the Commission and stated the following: • Was the President of scrap metal recycling and would like a recycling center at this location; and • Resigned from the company to pursue this project. Jack Vissing stated the following to the Commission: • Will not be able to see anything from the street; • Vehicles will be weighed corning in and weighed going out; • Will take automobile with fluids, if they come in with fluids will have a tech to remove all fluids then stored in tanks; • Vehicles will not be there for a long period of time and • Will also recycle aluminum cans, copper and scrap metal. Page 6of1© Jeffersonville Plan Commission Meeting —July 30, 2013 • John Campbell appeared before the Commission and stated the following: • Work with Brian and ISA with other projects in the past; • The existing conditions, currently there is about 150 feet pull off area but the roadway is not aligned with Keystone Boulevard; • There will be a defined entrance, will remove all of the gravel and planting evergreens and deciduous trees; • Don't envision any semi-truck, just mostly cars and trucks; • Outbound material will be on semi-trucks; • Have also included a lot of landscaping by railroad track and a buffer along property lines maintains 30' setback; and • Will be installing an 8' fence solid metal with plantings. Charles Newton, 4201 Utica Sellersburg Road appeared before the Commission and stated the following: • Owns B & J Trucking and is concerned about the additional traffic, there is already seven trucking companies in this area, not opposed to the development just concerned about the exposure of the railroad track; and • Concerned about the entrance and exit of the property in conjunction to my entrance and exit across the street. Jeff McCormick, 3918 Utica Sellersburg Road appeared before the Commission and stated the following: • Can see through the buffer that is in place now; • Concrete has been dumped on the property in the past and 1 can see it by looking out my back window; • Concrete is now running into the creek and is concerned about fluid and that it is property removed; and • Concerned about the noise and traffic and that the road is too narrow for this much traffic. Debbie McCormick, 3918 'A Utica Sellersburg Road appeared before the Commission and stated the following: • There is a drainage pipe that runs through his property and putting a. new development on top of the pipe is a concern; • The tree line is owned by CSX and they have removed the trees; and • Do not allow recycling at this site. John Campbell stated the following to the Commission: • The concrete will be removed in the area of the stream; • The culvert underneath the CSX Railroad that is actually upstream from our site; Page 7 of 10 Jeffersonville Plan Commission Meeting —July 30, 2013 • The concern about the declaration lane is that utilities poles would be impacted; • If there is a need for right of way dedication the applicant would be okay with that should the City decide to re-construct the road; • Will require water testing from EPA; and • Will construct a fence by the adjacent neighbors. Therefore, upon a motion made by Connie Sellers and seconded by Rita Fleming, the Commission voted 6-1 with Ed Zastawny voted against the application to approve the Development Plan with the following conditions: Construct a fence on the right side of the property; and Sidewalk fund in lieu of being used. e) PC-13-27 The next item to come before the Commission is an application filed by Industrial Air Centers, Inc., for rezoning property located at 219 Fulton Street. The property contains three parcels and 0.34 acres. The parcels are identified by the following parcel numbers: 10-19-00-100-904.000-010, 10-19-00-100-905.000-010, 10-19-00-100-906.000-010. The property is currently zoned R3 (Old City Residential) and the proposed zoning is NI (Neighborhood Industrial). The applicant is also requesting that 5.687 square feet of the Old Levee in Block 41 be zoned NI (Neighborhood Industrial). J. Bruce "Corky" Scales appeared before the Commission and stated the following: • This company was founded by George Burch, a Jeffersonville resident; • Been at this location since 1991; • 731 East Market Street is the corporate headquarters for IAC; • They are located in three states, Indiana, Kentucky and Ohio; • They currently have 72 employees; • The normal wage is $14.00 per hour but this expansion will involve persons in excess of $50,000 per year with some in excess of $100,000; • The proposed expansion to be approximately a 20,000 square foot addition to the building; • There will also be enclosed carport type building to house company vehicles and trailers and an enclosed fenced compound; • IAC is requesting that the two alleys behind the project to vacate the portion directly behind and provide a portion of their property to the west to reconnect the two alleys; • This project would be about a million dollar project for the City of Jeffersonville. Les Merkley stated to the Commission that there are three issues with this rezoning, the alley way will have to be vacated before City Council, piece of property in the middle is owned by the City so should you decide to send a favorable recommendation it must be contingent upon the vacating of the alley and transfer the piece of property out of the City's ownership. Page 8 of 10 Jeffersonville Plan Commission Meeting —July 30, 2013 Maria Bastian, 720 East Chestnut Street appeared before the Commission and stated the following: • Opposed to the application due to property being impacted in a negative way; and • Concerned about noise and additional traffic. Pearl Fanning, 738 East Chestnut Street appeared before the Commission and stated the following: • The new building will be at my back door; and • There will be lots of noise and smoke, so is against the project. Sue Muncy, 731 East Chestnut Street appeared before the Commission and stated the following: • Opposed to this project a 20,000 building in front yard; • Will have no view at all; and • Home is listed in Historical Register would be all in vain. Jason Pierce, owner of 219 Fulton Street appeared before the Commission and stated the following: • Owned the property for approximately nine years and the parcels behind there and an abandoned building with lots of trash and Mr. Burch brought the properties and cleaned them up; and • In favor of this application because they are increasing jobs. David Lauderdale, 710 East Chestnut Street appeared before the Commission and stated the following: • My garage is 5' from the alley and is concerned about traffic and height of building; and • Also concerned about hurting the property value of the adjacent residential properties. Therefore, upon a motion made by Rita Fleming and seconded by Connie Sellers, the Commission voted 5-2 with Ed Zastawny and Brent Roberts voting against the recommendation to send a non-favorable recommendation to the City Council for the rezoning of three parcels from. R3 (Old City Residential) to NI (Neighborhood Industrial). 5) Reports from Officers, Committees, and Staff Shane Corbin presented a bicycle and pedestrian plan to the Commission for approval.
